2 or 10 years green card ?

Timeline

My husband and I are just 1 week  from our 2 year wedding anniversary. If he gets approval of his visa tomorrow in his interview  ,  will he get a 10 or two years green card ?

You husband does not get his green card at the interview. He with get his visa.  He is still some time away from actually getting a green card.

 

BTW, you have K1 in your profile. You filed for a spousal visa correct?

 

Anyway, the interview he is going for tomorrow is NOT for the green card, it is for his visa to come to the US. He will not activate his permanent residency until he enters the US and receive his I-551 stamp at customs. So unless he is planning on flying here to the US tomorrow directly after the interview, he will get his actual permanent residency well after your 2-year anniversary.

I agree, the 2 vs 10 year GC from a spousal visa is determined at the port of entry, so even if the visa in his passport says CR1, he should get a 10 yr GC if he enters the US after your second anniversary.  This seems to be the potential here, so make sure you check it once he gets the physical GC assuming he enters after the 2 year wedding anniversary.

yes its cr1 visa   not k1

he will fly 1 day after  our 2-year anniversary.

so .. will uscis send us 10 or 2 years green card ?

are u sure that he will get 10 years GC if he arrived 1 day after the 2 year wedding anniversary. ?

Yes, because its an absolute requirement.   And if for some reason they make an error,  you get it fixed.

Yes, the GC becomes officially active upon approved entry into the US with a valid spousal visa.  If you have been legally married for 2 years at that point, then a 10 yr GC should be issued.  You may have you spouse mention it to the CBP officer just as a reminder as sometimes they forget.  When your spouse enters, they will stamp his passport and make a note on the stamp, and it should be something like IR1 even if the visa itself says CR1.  If he for some reason gets a 2 year card by mistake, you can get it corrected.

Neither. The US Embassy/Consulate approves immigrant visas; they do not issue green cards.  He will get a CR-1 immigrant visa. 

If he enters the US after your 2nd wedding anniversary with his CR-1 visa, he will get a 10 years green card.

 

If he enters the US before your 2nd wedding anniversary with his CR-1 visa, he will get a 2 years conditional green card.

yea .. I'm assuming that I'm going to delay my traveling few days so i get 10 years Green card instead of 2 years

I'm planning to fly on Feb. 27
