We submitted our package last September and finally got letters about the missing information. I know we forgot the I-130A and the I-864 and will be submitting them. However there is a new section talking about needing a I-944 Declaration of Self-Sufficiency. I'm unclear if this is needed. It says it would be if the I-485 is deemed inadmissible, however my wife is not self-sufficient as she currently can't work in the US. Is it basically another financial support form that contains just my information for taxes and assets? Any advice is appreciated.

 

It does say that last year a waiver was in place from July 29th-September 22nd which we fell into, but anything after February 24th requires the form.

The Inadmissibility on Public Charge Grounds final rule requires applicants for adjustment of status who are subject to the public charge ground of inadmissibility to report certain information related to public benefits. What visa are you adjusting from? If it's K1, no 130A is needed.

 

You also said you didn't submit a 864. If you didn't get a rejection, and they didn't issue a RFE for it, your case will most likely be denied. I've seen plenty of cases where they filed without 864, never got a RFE and just got a denial letter months later.

 

I-944 is mandatory for everyone that filed after Feb 24. It doesn't matter if it was blocked by a judge for some time.

Sorry I think I posted this in the wrong forum meant to put it in the Traveler Visa one. The reason we didn't send the i-944 is because we qualified under the waiver  that was in-place until September 22nd since it was received on September 11th.

 

Either way seems they are requiring it now since that is when they are working it. We did not get a rejection it is a RFE due by April 15th. So the questions still stand of what to put on the form as she has 0 information in terms of earnings, credit score, etc since she has not worked in the US and is a citizen of her country of course. The only household information would be mine which is what the I-894 is for and doesn't prove her Self-Sufficiency.

 

To me this form seems like it is made for individuals changing their status who have already been in the US working on a Green Card or Work Visa, not one that was just married and filing for Adjustment as we are.

There are a lot of posts here explaining how to fill it out.

 

Most of the stuff she will fill out with information from her home country. Like education, debt.

 

For credit report there are also a lot of posts explaining how to get a letter saying she doesn't have one.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
