How to bring boyfriend into country

Hey everyone. I am a male. My boyfriend (Brazilian) and I have been trying to figure out a way for him to get in the country, some how get a job, etc. We would be willing to get married but have no idea how this would work, especially given that we both have a limited income (causes problems with me being a sponsor). A work visa seems impossible because he doesn't have a social security number and I can't find any places that would sponsor him for a more basic job. Can anyone please give some idea of what could work out for us? Thanks

What is the purpose of bringing your boyfriend here first of all. Do you want to get married and live in the US? If so then marry and file a spousal visa. If he wants to work here then he needs to find a company that would hire him (not as easy as it seems and the company would file for the visa). He could also apply for a student visa if he wants to go to school here...but that is a non immigrant visa so if your long term plan is to be together then this wouldn’t be it. If he wants to visit then he can apply fir a B1/B2 visa on his own merits (you don’t do anything)

Why can't you go to him and get married? Or if you have meet within the last 2 years file a K1. If you don't meet the income guidelines you will need to get a joint sponsor that meets guidelines for their household size plus him.

 

And he can come to US and you get married and go back and you file for spousal visa. so you have 3 options.

If you have met him in person in the last two years, you could petition for him as a fiance.  You will need a financial cosponsor IF the US Embassy/Consulate in Brazil accepts financial cosponsors (you would need to check this out in the Brazil subforum on VJ).  The problem with this path is that after marrying in the US, he would need to adjust status for a green card and wait about 6-8 month for his work authorization to begin to legally work.  Since money is a problem, this is not the best way to get him here.

Same sex marriages are legal in Brazil, so you could go there and marry him.  Then, you could petition for you him as your spouse.  You would need a financial cosponsor for the I-864 and the US Embassy/Consulate will accept a qualified cosponsor.  Upon entering the US, your spouse would automatically get a green card and be able to work.

There is no way around the financial requirements.  The spousal visa path allows for a financial cosponsor.  

A work visa will be a non-immigrant path.  Does your fiance have a college degree?  He would need an employer to sponsor him.  And it will not be for a "basic job" if you mean an unskilled job.

Marriage with tourist visa is allowed: https://uk.usembassy.gov/visas/immigrant-visa-faqs/

If you will return to your permanent residence you may apply for a tourist B-2 visa, or if eligible, travel visa free under the Visa Waiver Program.  At the time you apply for the visa and/or travel to the United States you will be required to show that you have a residence outside the United States that you do not intend to abandon. There is no set form that this evidence takes as it varies with each person’s circumstances.

Have you met the requirements for the K1 visa, as far as the meeting requirements?  If so you can apply for the K1 visa.  Or, as mentioned before, you can go the Brazil and marry him there.  Or, are you looking to have a marriage in the US before trying to fo the CR1 route?

It will be difficult (but not impossible), for your boyfriend to get a B2 visa to visit the US to marry you here, because of the fact he has a love interest in the US, and has strong immigration intent.  To get a B2 he will need to show strong ties to Brazil, and convince the officer he will go back.  You could go to Brazil to get married, I did this,  Just know that the Brazilian bureaucracy is a big challenge with lots of documentation, apostilles, FedEx fees, translations, fees, wait times--it took us five months and I had to do a power of attorney so that my husband's friend could sign the marriage application papers on my behalf.  Then after our marriage in Brazil I returned and filed an I-130 petition for him.  He's been here in California for a year and a half now.  The problem with getting married in Brazil is the COVID situation, right now you could not enter the country.  Even if he had a B2 visa, he could not travel to the US until the pandemic travel restrictions are eased.  You could get married in a third country like Mexico or Argentina, look into that.  We looked at Argentina where same-sex marriage is faster and easier than Mexico, but decided in the end on Brazil so that his family and friends could be there.  If you have met in person during the last two years, I strongly recommend a K-1 fiancé visa in your case if he is ok with no work or international travel for 8+ months after arrival and marriage in the US.  Sounds like you'll need a financial co-sponsor as well so start working on that.  It's going to be a long road, especially these days with COVID, but if you really love each other, you'll find a way to be together.  Good luck to you both!

Brazilians with B-2 visa cannot travel directly to the US but can still go to Mexico (or other unrestricted country) for 14 days and then fly to the US. Starting on Jan. 26, they would also need "proof of a negative COVID-19 test or documentation of having recovered from COVID-19" before boarding the flight to the US. https://www.cdc.gov/quarantine/fr-proof-negative-test.html

There's no risk in him applying and being honest (no manufacturing ties). The only risk is losing the $160 if he gets denied. But if comes and visits you, you can get married, he can go back home and you can file for a spousal visa

 

But you will definitely still need to have enough income to sponsor him or find a joint sponsor. Spousal visa processing takes more than a year, so you have time.

Do you want to marry or just want him in the country? You said "we would be willing to get married", which doesn't sound promising. There is nothing easy about the process and you have to know that you want to marry for either the K1 (fiance) or the CR1 (spousal) visa. For both you'll need to either find a way to earn more income or find a co-sponsor.
