IR2 to F11 : Suddenly changed

Hi ! My sibling has a interview in US embassy manila this February 8 2021 with my mom. He is 23 years old but when my dad filed a I-130, he was 20 years old . We got a email form embassy that the appointment is canceled because he turned to 21 on June 2018. Then, his Visa class changed form IR2 to F11. His case should be freeze when the time my dad filed a I-130 right ? Child Status Protection Act should applied to him. Why did they changed it ? Please help me

My dad is US citizen btw

Yes, IR2 age freezes at time i130 is filed. He should raise this with the embassy. I believe you have seen the Uscis extract in another thread that shows this.

 

It is very odd that it took so long to get an interview if i130 was filed in (I guess) 2017, were there any complications with the case?

I saw CSPA to prevent age out. What should I do ? I did contact NVC but they told me to call US embassy Manila since the case is in Manila. I'm very nervous because F11 might take 6 years ..

Yes, as I also said in first post the embassy needs to be contacted. You cannot do it as it is not your case, either your brother or your father should do it. They can include a copy of the USCIS page on CSPA as evidence and request that the case be reclassified back to IR2 and an interview scheduled. If the embassy is not helpful then your father should contact his congressperson for assistance on following up.

If the facts of the case are as you explained, then yes they made an error. I cannot guarantee they will fix it, which is why I suggested an alternative option in the case that they do not. 
 

Question: you didn’t answer about the length of case. Just to check on an assumption, was your father a citizen when he filed the i130?

It took almost 2 years because we could not submit a documents properly. Yes, he is USCitizen

Same situation to my son , nvc said he still in IR2  and we need to communicate to the embassy, but it’s so difficult to contact them by call or email..  It will cause of frustration and confusion!  Even you know you are ready for interview suddenly visa class was shifted!

Hello guys! He finally got his interview date . We got his interview letter on May 31,2021 and his interview would be June 8,2021 ( Philippines time ) his case still F11 and we hope that on his interview will be change back to IR2 . I'll let you know what will happen to his interview. Anyway, his case was expedite by US embassy and we did not asked to expedite it. Hope your case will expedite too .
