Timeline

Good day! I hope you are all having a good start of the year.

I can't find a timeline/progress discussion for December 2020 filers so I created one. 

I know it's too early to create a thread like this but seeing someone whose application is moving makes me hopeful and at peace. 

 

For anyone who filed their AOS application in December 2020, please feel free to share your progress in this thread!

Our journey so far for concurrent filing of I-130 & I-485 with I-765 & I-131:

Current Visa: B2

Service Center: NBC

ASC: San Diego, CA

Priority Date: 12/21/2020

 

2020

12/16/2020: Send packet via UPS

12/21/2020: Chicago Lockbox received the packet

 

2021

01/05/2020: Credit card charged for I-130 & I-485

01/11/2020: Received e-notification via text message

01/15/2020: Received NOA for all of the forms // NOA dated: Jan. 09, 2021

Current Visa: B2

Service Center: NBC

ASC: Yakima, WA

Priority Date: 2020-12-07

 

2020

2020-12-02 - Mailed via USPS.

2020-12-06 - USPS tracking reports delivery to Chicago Lockbox.

2020-12-07 - 130, 131, 765, 485 Priority date (as reported by the NOA letters).

2020-12-11 - USCIS case status website shows the biometrics fee was accepted (as reported by the 485 tracking number).

2020-12-15 - Bank reports payment checks cashed.

 

2021

2021-01-02 - NOA letters (all four of them) received. NOA dated 2020-12-21. Despite requesting it via G-1145, we never received any electronic communication confirming receipt.

2021-01-30 - Biometrics appointment letter received.

2021-02-17 - Biometrics appointment (Yakima).

Timeline

Update: As scheduled, went to the biometrics appointment today. The process was painless. 10 fingerprints + 1 picture in 3 minutes + 15 minutes of waiting. The case tracking website is now showing the fingerprints as received for both I-485 (AOS) and I-765 (EAP). Visa journey's timeline estimator is currently setting our hopes at a mid-June arrival for the EAP and AP card.

Hi all!  I'm new to this website so would love you to highlight things you've found particularly useful... I found it by looking for timelines.

 

I filed I-130, I-485 and I-765 in December.  I'm a UK citizen, was here on an 18 month J1, got married and now out of status whilst applying for AOS.

 

Current Visa: J1 (expired)

Service Center: MSC

ASC: Bronx, NY?

 

2020

12/04/2020: Send packet via UPS

12/07/2020: Updated online that i-765 received

12/12/2020: Updated online that i-130 and i-485 received, fingerprint fee taken

12/22/2020: Receipts for all forms through mail

 

2021

02/18/2021: Bio appt (Bronx, NY)

02/19/2021: Updated online that fingerprints have been received.

 

I have a question about the i-131... we were strongly advised by our lawyer to not file for the i-131 because there is always a chance that you wont be let back into the US and so it could jepardise the application and that I would have to show a particular reason (emergency) to file it.  But everyone else on here has applied at the same time.  Has anyone else heard anything similar?

I suggest ditching that lawyer.  As you may have seen from browsing these forums, many VJ members have filed I-131 with their I-485 without issue.  I don't recall any Adjustment of Status case that was jeopardized simply by filing the I-131.

It's not the filing of the I-131 that she says is the risk but that there's a risk in re-entering the country with the AP.  And that the purpose of the AP is for an emergency.  She says:

 

"The travel document is used if you have a planned trip with a date certain outside the United States for  “urgent humanitarian reasons” or in furtherance of a “significant public benefit,” which may include a personal or family emergency or bona fide business reasons. If you file the I-131 and it is granted, your application will not be considered abandoned if you leave the country. 

 

I am pretty cautious during the pendency of my client's adjustment of status cases. I always warn about the risks of traveling, domestically and especially internationally. There's also an additional risk now with travel due to the virus and the possibility that you may not be allowed to reenter. If you take a look at the instructions on the I-131 there are travel warnings: "DHS may revoke or terminate your Advance Parole Document at any time, including while you are outside the United States, in which event you may be unable to return to the United States unless you have a valid visa or other document that permits you to travel to the United States and seek admission" and "leaving the United States, even with an Advance Parole Document, may impact your ability to return to the United States." Here is the link to the instructions: https://www.uscis.gov/sites/default/files/document/forms/i-131instr.pdf. So for these reasons, I do not file the advance parole document unless it is specifically requested."

 

I, of course, don't want to do anything that jeopardises my AOS but 1) it seems the norm on this website for people to file it and travel and 2) I haven't seen most of my friends and family for nearly 2 years and the waiting time for AOS is up to another 2 years and I'd just like to go see people I love when lockdowns are reduced!

 

I wonder if it's too late now anyway to file it as I've already had my bio appt.

You can still file! I submitted my I-765 with my AOS package 09/28/20. I then applied for my AP 01/05/21. Somehow my AP was approved 02/09/21, still waiting for my EAD.

09/25/20: AOS package (I-130/I-485/I-765/I-944) mailed out via USPS.

09/27/20: Package received by USPS.

10/24/20: Received NOA1 in the mail. PD is 09/28/20.

01/05/21: Biometrics appointment completed (Brooklyn ASC). Case updated to show fingerprints were taken (I-486 & I-765).

01/05/21: I-131 mailed via UPS.

01/17/21: Received IOE receipt number for I-131 via text.

01/25/21: Received a biometrics reuse notice for I-131.

02/02/21: I-485 Case is ready to be scheduled for an interview.

02/04/21: Received I-693 deficiency notice in the mail (dated 01/29/21).

02/09/21: Advance Parole document was produced.

02/16/21: AP in hand.
02/26/21: New Card Is Being Produced (EAD).

03/04/21: EAD in hand.

09/01/21: EAD renewal paperwork received by USCIS. IOE receipt number.

09/07/21: Receipt / 180-day automatic extension received in the mail.

09/09/21: Received a biometrics reuse notice for I-765 renewal.

10/25/21: AP renewal NOA and biometrics reuse received in the mail.

11/04/21: Interview was scheduled for 12/02.

Good to know, thank you!!  I think I will file to have it "just in case", even if I don't use it.  One of my worries about this process is what if one of my parents were really sick and I couldn't just jump on a plane .  Did you have to put dates or a reason down?

 

Hopefully, your EAD will come through soon... I've seen a lot of action lately in the September filers thread so things look like they're moving along.

I had done my biometrics earlier in the day that I sent out my AP application.

I said I might have to travel abroad for a research project I’m a part of. But I’ve seen that many applying for AP through AOS do not to give a specific reason/dates/locations they plan on traveling. Those instructions are aimed more at DACA holders and people holding other statuses. 
 

And thank you! I’ve seen some movement, too! I’m not in too much of a rush because I’m an F-1 and I’m currently working under 20 hours at my school, but it would be nice to have it just in case.
