My lawyer filed I-130 for my son in Dec 2020 and we still haven’t heard back from uscis. I’m angry she didn’t file online to save time. Should I file a new I-130 online or tell my husband to file one online to speed things up? We’re aware of having to pay fees again but we want to save time and our lawyer said paper based takes 2-3 months for uscis to respond and acknowledge receipt. She said paper based I-130s in Nov 2020 from her other clients haven’t had responses yet. My cousin though submitted I-130 in Nov online and already heard back 2 weeks later. What should we do?

Hard to say at this point whether you should confuse the system by filing a duplicate application.  Just because the response has not been received yet does not mean it is not in the system.

I would not file a duplicate. Just be patient.  Nothing happens fast in immigration.  All cases are different and service centers are different.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

But if I don’t file electronically but my spouse for our son, that should work and whatever gets approved faster, we continue working on that one?

But if my spouse files an electronic application under his name, that is not considered duplicate?

Possibly, but not really seeing the upside here.  While I agree, you should have dispensed with the lawyer and filed it yourself online, it seems water under the bridge, and it would just put in a 2nd application for the same person to further slow things down not to mention the added money to potentially shave off a few days.  Of course it is entirely up to you.

Your choice....but you take the chance that the paperwork will cross somewhere and create some confusion for USCIS or yourself down the line.

So what should we do now? Just wait 2-3 months and see if things are moving? Everything is too late now?

You can't file twice on the same case, in your scenario, I-130. Remember every approved petition has an alien number. Suffice to say, 1 alien number is equivalent to just 1 person.
