People here with experience are of the opinion that this is the wrong one. Consulate has also denied this one. This is accepted by NVC but consulate asks for one which says ---- "Other (Provide details)". Suggest you get a new one.

The fingerprinter was kind enough to tell me, that "for non-certified criminal information." does not include sealed / suspended sentences whereas "Other(Provide details)" does, so kinda makes sense that the preference is for wholesome record.

Thanks! All the posts I read about this had OTHER - I will get a new one.

Hello everyone!

Long time lurker on this thread, and have found lots of helpful advice here.

I am the U.S. citizen and my husband has an asylum case pending in Canada, but is there legally and has a work permit. When he crossed the border (initially was in U.S. but didn't overstay his visa), the Canadian government seized his passport and currently still has it. We were DQ'd in June 2020, and hoping that his IL is in the next batch.

I'm aware that he will need his original passport for the interview, but am unsure about what he should do to make sure he has it for the interview. I'm worried that if he requests his passport back, it will end/affect his legal status in Canada which obviously won't be good for the interview stage.

Should he request to have it back for the interview? Get a new one made? Any guidance/advice on this would be greatly appreciated!

This is probably beyond VJ / Reddit paygrade.

My opinion.

You can request from IRCC the passport, they may or may not give it. Unlikely its gonna get processed in time, so might not be, even an option. Unlikely its gonna affect the outcome of case in case they do return it.

I am not sure what is the home country, but once you apply for an asylee status, the home country might not even recognize / help the citizen until a decision is made (And in case of South East Asian countries, you get prosecuted for falsely claiming asylum after returning home after denial), so I do not think you will able to get a new passport done.

Tried to look up some content and got an old doc from MTL consulate that if refugee status, to get those documents. Not sure if its still applicable today. My suggestion would be to contact the consulate via email and see what they say.

Hmmmm - after reading on another forum, Privacy Act Request Type - FOR NON-CERTIFIED CRIMINAL INFORMATION is deemed ‘acceptable’,  as it was done before the change took place on Nov 1st ..... 🤔

I just sent an email to the montreal consulate about the criminal records check.  Hopefully they'll be prompt and send an answer.  I'll post what I get in response.
