I had a legitimate chuckle at this LOL!  Mostly because it's true and it really would be interesting to work it out!

I actually found it tough when people would continuously ask...kinda like if a woman is pregnant and is close to the due date and everyone asks if the baby's been born yet.  Don't worry...you'll find out because when that interview letter (or a baby in the later case) comes, E'ERYBODY gon' know!  A baby is at least more predictable than an interview letter, though!

Same. Don't your in-laws ask how come those illegal migrants can just cross the south border and come to the US, and those who are going through the legal path like us have such hard time coming to the US? 

 

When I started this process 2 years ago, I explained that this should take 10-12 months based on the past track record, then I realized it's taking even longer these days so I said maybe 15 months, then the pandemic hit and now I'm still waiting for an interview to be scheduled after 2 years.

I think I aged a lot with all the stress and anxiety while they keep moving away the goal post.

TBH every morning this week that I didn't have an email, I was actually even more stressed out until I hopped onto the VJ forums and saw that others didn't get one either. I can handle waiting another day (or week) for the letter - my real fear is not being in this next batch of interviews.

Not to nitpick but the only "illegal" migrants are those crossing between ports of entry and not seeking asylum, who are looking to obtain status by making meaningful establishment over the course of years. Seeking asylum through irregular entry is legal per international law which appears to be most of the people who are crossing at the moment.

I see what your saying, but of course those who cross the border will claim they are seeking "asylum" as it's the only way they can potentially legally stay in a long haul. There are of course legitimate asylum seekers too, but there also many who are crossing the border because of economic reasons by playing a game with the system to enter the US. At the end of the day, the US government decides who are the legitimate asylum seekers, and the very fact that many of them being deported after the assessment means they didn't have sufficient evidence to support their claim of being asylum seekers. 

International laws is a tricky thing as there is nobody who can actually enforce it, and it's really up to each country to honour it.

You're right, there has been virtually no enforcement of the 1951 Refugee Convention and Protocol and it's usually up to domestic courts to enforce transposed domestic laws. While we may presume to come to our own conclusions regarding the general refugee claims made at the border, the correct process is for a refugee to make a claim for asylum on US soil and have the government determine if it is a valid claim. Usually frivolous claims are handled relatively quickly as they go through a 'credible fear' assessment, this essentially roots out those frivolous claims. Additionally the US frequently detains those seeking asylum until their case is adjudicated which can take a long time. If you want claims to be handled properly you would support the timely adjudication of such claims. It is on the whole not a 'free ticket' to the US.

 

Additionally, the US has a class of inadmissibility for frivolous claims to asylum to prevent obtaining other status.

 

Now personally my thoughts regarding immigration control might be controversial here, but honestly, from a neutral standpoint the government has cast a balance between handling frivolous claims and complying with their obligations in accordance with International Law. Do I think the US is in full compliance with their obligations under international law? No. I don't, I think indefinite detention and poor conditions thereof are wrong and I do believe that the Safe Third Country Agreement should be suspended until the US is up to snuff with its obligations.

Question regarding passport renewal around the time of interview - I was DQ'd last December and hoping i get my interview in August/September (fingers crossed). My Passport is set to expire on December 31st 2021, and was planning on renewing it. Should i avoid renewing it before my interview? Would I have to renew it before I travel to the United States to show at least 6 months validity on my passport? Appreciate the guidance -

Absolutely get the renewal sooner rather than later. You need the 6 months valid when you cross the border so I doubt they'd put the visa in your old one. And if they did there's a whole thing to get a new one put into a new passport. Renew it now, and opt for the 10 year passport! Save yourself the hassle 😊 I'm good til 2029 and it's very freeing.

 

You can ask to keep your old one and they're 'destroy' it by putting a hole through it. Then you can bring the old one and the new one to the interview, and you can just upload the new one to the portal!
