Over the past couple of years there have been several pregnant Montreal couples with denied expedites. Montreal rarely expedites any situation.

For sure, I think they consider literal life/death situations, as in the petitioner being terminally ill for example. Not, the inconvenience of having to apply for a CRBA or matters regarding family separation (as that's something almost every applicant is dealing with).

I might be wrong, but an NVC expedite is to speed up the NVC processing, that is the review of your documents ahead of your case being made DQ'ed. A consulate expedite, or more correctly 'an emergency appointment' is made to the Consulate or Embassy that will be interviewing you. The onus is on them to scoop out your case from the DQ queue.

See the VJ opinion on Pregnancy Expedites here, btw:

Thank you both. Good to know.

Hello there,

From what I understand, pregnancy isn't grounds to expedite an IV interview, but you can certainly try and request it. You need to email the Immigrant Visa Unit at montreal-iv-dv@state.gov to request it. Montreal is very, very strict about granting expedites, so I wouldn't bet on getting it.

What you'd need to do is book an appointment for a CRBA (Consular Report of Birth Abroad) for your baby if you don't give birth within the US. This document proves that your baby is a US Citizen at birth on the basis your spouse's US Citizenship. Hope this helps!

If it comes down to it and I had to file a CRBA, would I be able to take baby to the States no problem once I get my visa? How long does processing take? I know they're not allowing Canadian citizens to drive across the border unless they have visa/permanent residence. I was in Canada in February and we had to fly back to the States even though we were allowed to drive in to Canada.

I'm not sure. I would imagine your baby would need a basis on which to enter the US be it a visa or citizenship. That being said, parental custody is considered essential travel so you might be able to get over the border. Other members who have gone through the CRBA process would be better able to advise as our only 'child' is a husky-mix who fortunately only needs a rabies certificate to get over the border! :)

Hi,

Does anyone know what are the status changes of Green card after paying the fees and activating the CR1 visa? As of now, status is showing Immigrant Visa Fee Received.

Haha thanks! Well I'm not quite halfway through my pregnancy so I found some information just in case but I'm not going to let it worry me. Stress just makes things worse. So far things have been working out for us, thank God.

My husband had his interview this morning and was approved! He was in and out of there in 40 minutes, said that the only documents they requested were our original marriage certificate, his birth certificate and his passport. The officer interviewing him asked only a few questions:

-what is your wife's name?

-what does she do?

-what does her mother do? (because she is acting as the joint sponsor in our case)

-what do you do?

After that, he said he will be approving the visa and handed him the "welcome to the USA" letter.

He drove to Montreal yesterday from Toronto and crossed the Quebec border around noon. No police in sight and no stops. Drove back today and there was a checkpoint at the Ontario border but they waved through everyone with an Ontario license plate.

Now will wait for the passport to be mailed back! Overall a smooth morning :)

Congrats! :D Did you upload an updated Affidavit of Support for the 2020 tax year into CEAC by the way?

Since you mention it ? Do you have to upload all the new documents for the TAX including new W2 for this year 2020 into CEAC, cuz originally I submitted the tax for 2019 ? or you can just bring them to the interview ? which way is better ?

I'm planning to scan/upload the updated Affidavit, 1040 and W-2 into CEAC prior to my interview, apparently it makes it easier for the consulate. And if it's easier for the consulate, easier for me, win-win. Either way, I think it's a good idea to take the physical copy with you to the interview.

As someone else said, it's better to have it with you and not need it rather than be asked for it and not have it and get kicked into AP for bit.

That really leads me to think Montreal just does there own thing.

It's seems pretty usual that each consulate has its own set of requirements. I think at the overburdened consulates the bar for an emergency appointment is that much higher because that's a slot that could've gone to someone who had been waiting a long time.

Thanks for the info Kai. I agree with you, is better to have it than not. But to upload a new Affidavit of support I 864 sounds excessive cuz the same information is there. I think to uploading the new W2 also 1040 for the year 2020  should be enough.
