Received passport today (after over a year of AP). Was informed by consulate in multiple emails that it would be IR-1 however it says CR-1. Anyone else cross with a CR-1 and get the border guards to convert to IR-1?

I understand by law as you will enter the US after your second anniversary of being married you should be granted a 10-year IR1 Green Card. I've seen those who have the CR-1 designation on their visa but entered after the 2nd anniversary be granted the 10 year card as it is counted from the day you become a LPR.

You should let CBP know the date of your wedding anniversary and that you should be granted the 10 year card. If you ultimately end up receiving the 2 year one, you can file form I-90 for free to correct it.

Hi everyone,

 

my Visa was approved today and here is how it went.

 

- Reached the Consulate a little early but the guard did not let anyone in until it was the time.

- simple basic Covid-19 questions, security check and they send you upstairs.

- first window they collect your passport and give you a number that they will use to call you.

- second window they did fingerprints, asked passport size picture, collected PCC and birth certificate, asked current and intended address plus some basic info such as it is your first marriage and what is your name and DOB.

- third window: after taking the oath they asked question like:

   - name of the petitioner?

   - who was present at your wedding?

  - date you got married?

  - where you met her?

  - when did you start dating?

  - what does she do?

  - what do you do and what you plan to do once you move to the US?

  - I had a sponsor so they asked me the question what does the sponsor do?

  - where will you be living? 

  - did you read the pamphlet? what does it say?

 

After that the officer approved my visa giving me the Welcome to the US paper and told me that I'd get my passport back in 3-4 weeks maximum. 

 

I stayed at Best Western Hotel, decent price, good hotel and fairly close to the Consulate ( 3-4 minutes walk ).

Actually, 14 months. And now they’ve issued the wrong visa category. Have sent them an email asking what to do amd will keep everyone posted.

CBP won't touch it; USCIS will make the adjustment.  When you receive your physical green card, it should reflect the change if you entered after your 2nd anniversary.  If it's incorrect, you file I-90 paperwork and they update it.  Mine and Kid1's came with the correct status of IR.  Kid2 had CR; I got it changed at no cost other than time and the courier fees for the application.  No clue how you get 2 out of 3 correct, but I stopped asking long ago!

Don't bother getting them to update it, it'll just delay you further if they'll even do it in the first place. USCIS will adjust it when they print your green card and if they don't you can get it fixed for free (this is all assuming that you'll be activating after 2 years of marriage, which after 14 months of AP is almost a given). You'll definitely want to make sure the green card is correct but having your visa printed as CR1 instead of IR1 will not make the slightest difference as both are treated the same and will allow you the same rights in the US while you wait for your green card to be printed (or re-printed if they get it wrong).

My visa got approved today. The consulate accepted the expired foreign PCC with no questions asked. Thank you all for the helping each other out!

 

Interview went smooth. The only docs they wanted to see were Passport, Birth Certificate and English Translation, Marriage Certificate and Police Certificates. I uploaded the IRS Transcripts beforehand which might be why they didn't ask for them.

 

Questions asked:

1. How and when did you meet your spouse?

2. When and where did you get married?

3. How many people were present at the wedding?

4. What is your and your spouse's occupation?

5. What was your longest stay in the United States?

My interview was this morning at 10 AM and my visa was APPROVED! Thank you all for the information. Shout out to @Hawk Riders for maintaining the spreadsheet. 

 

Interview went smooth, I was out in little over an hour, super quick. They asked the basic questions that everyone has posted.

Well, Ontario has gone into a lockdown situation (stay-at-home order) starting tomorrow for 28 days.  We have the medical check tomorrow in Vaughan, ON.  I think that is allowed as it is a medical checkup.  But, our Montreal interview is next Wed, and travel is restricted in Ontario to essential only.  Could be tricky justifying that trip to an officer if we get stopped!  Still planning to go, will have to stay at hotel near the consulate as drive time is about 8hrs each way.

Keep your interview letter handy and show it to an officer if you get stopped. An interview at a consulate that you didn’t set the date to is non-discretionary travel
