Thanks so much for taking the time to make the doodles and show it! I would bring it to the interview. I also heard from credible sources that overstays and denials are forgiven when you apply for I130 so I am sure everything will be fine :)

:) you're very welcome. I have it in my folder of stuff to bring with me to the interview. I figure even if they don't ask, better to be safe than sorry. Also all my flight itineraries, and his as well coming to Canada to visit. I have WAY too many txts, emails, facebook messages calls to even know where to begin with those. Emails alone are over 9k (Damn!!)

Amazing. I am conflicted whether I should bother with printing out thousands of msgs and pictures because no one on here has mentioned that they ever ask for that - it doesnt seem like they do. I havent seen anyone on here mention that they actually asked for texts and more pictures at the interview phase. I expect to be asked about the denial and the questions everyone on here mentioned but you never know right

Hey All,

Thank you all for sharing your experiences and giving advices. Wouldn't have made this far without you all.

I am facing a potential issue which is giving me a lot of anxiety. My interview is coming soon (7th April) and I have all the docs except an updated PCC from India. I have one that expired in January.

The thing is, I don't live there anymore and I read somewhere that I don't need an updated one if I am not living there at the time of the interview. I did visit India for a couple of weeks last year.

I have applied for a new PCC but the consulate is taking its sweet time giving one out.

I am worried that they might not accept the expired PCC. Does anyone have experience with such issue?

Thank you for your support!

Police certificates expire after one year, unless the certificate was issued from your country of previous residence (India in this case) and you have not returned there since the police certificate was issued.

Thanks for clarifying Vir. The last point in the link says, "You still live in the country that issued the certificate." That's the issue I am facing. I did visit India for a couple of weeks after my PCC was issued. I am not sure that would constitute to returning back. Given that last condition, I am thinking they would ask for a new PCC if I was living in India. (I hope I receive the new PCC on time so this would be a non issue).

Mine happened in Toronto too! The YYZ secondary customs that left me traumatized for years lol. Right after weve already gotten married in the USA, I went to Canada for a visit and when I tried to return back to USA, it got complicated. The first officer who walked me to secondary was very nice and advised me that at this point we  file I130. At secondary, the first officer denied me because he said at that point he sensed intent to stay in the USA because Im already married to a citizen (at that point we had not filed anything yet and I said we are still figuring that out and I am just going back to visit and we will file after my visit), I asked to speak to a superior who admitted me but because of all this I missed my flight and the next one was the next morning which meant that I had to leave the airport. which I did not know meant that I will have to go through screening all over AGAIN and it will be up to the NEW officers discretion  whether or not they want to admit or deny me and they decided to deny. At first I was upset at the inconsistency because I got an admission stamp literally the previous day and she said that doesnt matter. This one didnt even let me speak to their superior. She gave me checklist with the documents I have to show next time I try to enter that basically prove my ties to Canada. Our lawyer even said I got lucky because she could have denied or even banned me if I pissed her off enough lol. Anyway, I was able to gather the documents in a few days and was admitted by a different officer lol (I guess he was in a good mood that day). It is upsetting how much inconsistency goes on though and lets just say my interactions with the customs officers have been traumatic. Having nothing but good intentions (just havent done the research, which we regret and take full responsibility for) and being interrogated and treated like a criminal is not a good feeling and one I never thought Id get to experience. But also like you, our lawyer advised me not to try crossing again without the GC approval and I havent.

Hey what did the checklist include for you to prove ties to canada? I am planning on visiting my husband snd of april and i am taking my work schedule that shows i took a month off as vacation. Do you mind sharing that checklist

We were recommended to possibly have a sign letter by our workplace stating that you will still have a job when you return, recent pay stub, a mortgage or rent statement (if possible) basically anything that seriously binds your ties to Canada.

I always advocate for having as up to date documentation as possible but I think you might be able to scrape by on this one because that page also says:

If at the time of your interview the following three items are all true, you must bring a new police certificate to your visa interview:

  • You are more than 16 years old;
  • The police certificate submitted to NVC was obtained more than one year ago; and
  • You still live in the country that issued the certificate.

As you are not still living in India and going back for a visit doesn't constitute living there, all three conditions are not met and so you should be fine unless you get an officer in a bad mood.

I am not a lawyer and nothing I say is or should be taken as legal advice.

You are absolutely right in advocating that DGF. In my case the Indian Consulate is taking forever to process the PCC. As you mentioned, hopefully they accept the expired one if the new one doesn't arrive on time. Will update you all. Thanks for you input!

I think @Hawk Riders commented on this one saying if it is Issued - Administrative processing, the visa is approved. Someone had this question couple of weeks ago too. Good luck!

How do you check status after the consulate interview? It seems the person who interviewed me circled the wrong link and I cannot seem to find the right info. Also when I try to pay the 220$ fee online for green card processing it continues to give me an error message. Anyone else having the same problem?

Try the link below for status

The $220 fee is paid once you physically receive the visa and have to put a visa number in the website!
