@mam521 thanks very much, particularly for the last paragraph. I already know about the gains and quarantine and such  I haven't had my interview yet. It should be in May, which, if all goes well, we should be ready to go by end of June, when school ends, but I have to fix and put my house in Canada on the market plus finish some major renovations to my husband's house because of the Texas winter storms, and have to get it all done before school starts in Texas in August (renos during hurricane season so let's add more stress to all of this). My teenager is on the spectrum so it is absolutely necessary for their mental health to complete one thing in one place before starting in another place. I just wanted to suss (not sus) out if it would be possible since I haven't seen my husband in person since November and would have loved to just go and be there to start things before I left Canada for good.

I'm in Texas.  The biggest issue right now is availability of materials because SOOO many people had damage.  We were pretty lucky because my "northerner instincts" kicked in.  It sounds silly, but most of the northerners I know fared much better than the locals or the Latin Americans!  Are you guys doing a lot of the work yourselves?  If not and you're hiring contractors but hubs is working, I'd highly recommend waiting until you're available to oversee the work.  So many cut corners when left to own devices!

As for hurricane season...meh...Texans do ok with hurricanes.  Just make sure if there's one on the horizon and you desire bread, eggs, milk and bottled water, you buy early!  If you're coming to Houston, follow Space City Weather for the best weather.  Eric and Matt had THEE BEST information during Hurricane Harvey.  They don't get drawn into the drama and are quite pragmatic to their approach on forecasting.  It's a breath of fresh air.

I don't know what school district you're in, but I'd reach out now and start the conversation with the school principal and the councilors at your kiddo's new school.  It will allow your current learning team to work with the new learning team and prepare to get the 504 in place for the special needs accommodations. Its even more important because school ends in May down here.  I realize it's something else on the heaping plate of ####### to do and boxes to tick, but it will actually make everything easier in August.  You'll sleep better too, knowing you've already got the plan in place.

Kid2 has a mood disregulation disorder which keeps things "creative" and we've had to have accommodations put in place (there's a whole lot of other back story that includes the school district here and I will say the district is AMAZING).  I was extremely lucky because the assistant principal couldn't wait to have Kid2 back (we had to pull the kids out of school to go back to Canada while our green cards were pending).  School in Canada was far from successful for Kid2, so we couldn't wait to get back and get to the school we knew, loved and understood the best way to deal with Kid2.  Unfortunately, it was only online, BUT the AP was instrumental in the transition to middle school and working with the staff there to get everyone up to speed on what worked (or didn't) with Kid2.  I was really pretty angry that the school in Canada didn't work harder with the school in Texas to help my kid with success.  But, that is the past and we're moving forward, accommodations in place and the care of the district here shows.

Has anyone ever had to say at the consulate that they were denied entry to the US, and will that mean you will not be approved?

During the whole Covid mess I visited my husband in Canada and then he was denied entry at the land border at one point for a visit because of Covid. We did not realize at the time he could have flown, just not drive over.

They did not get him out of his truck or inspect the vehicle or search his things. He had the appropriate paperwork that you take to visit that lawyers recommend you have to show ties and intention to visit and go back. He was simply turned back because of Covid restrictions.

He, of course, will not lie if they ask if he was denied entry, and he will tell them that although they didn’t interview him or state they felt he was crossing with bad intent, he did try to visit and couldnt.

This process has just been so long and I think that now that it is becoming real I am so scared of the worst happening. We, of course, would not have tried to do anything to mess this up!

I highly doubt this will lead to a denial of your case. 🙂

Re-do. Contact the place which printed you (if it was recent they still have prints on file) and specify you need a

"Criminal Record Check for Personal Use, type: Other."

Please see this tab on the spreadsheet https://docs.google.com/spreadsheets/d/1LvnDvX95_tfWtTvsJJM49PDPPvPKal0WG2rgdZHhsz0/edit#gid=1591174570

Yes, many couples have visited for 6mos.

Hello, I have the same problem too. I recently renewed my police record and my agent was aware of the recent change (Private Act Request to Criminal Record Check for Personal Use) and he said he had been following the new requirement for so many applicants for US immigration.

Then the one I received was stated as following,

Type of Criminal Record Check for Personal Use: For Active Criminal Record

not "Other"

It must be "Other" Is there anyone who had the same type of police record and accepted or denied at the interview?

Anyone know if my IR1 visa will be denied due to overstay (leass than 180 days). A few years back when I went to visit my then fiance we got into a motorcycle accident and we were injured. I ended up staying past my 6months by a month. I came back to visit him 7 months later with no issues, but the time after that (Nov. 2018) I was refused entry at the Calgary airport border.  They had it down as me changing my mind about visiting, no charges were brought against me, and I was told I could try again at a later date. My then fiance came up to visit me in Feb 2019, and we decide to just go ahead and get married while he was here. I have been to visit him 4 times since we married and have had no issues at the border. I did disclose my overstay in our IR1 visa application, and we have been DQ'd Sep 21, 2020. I am just really nervous that I will be denied at the interview because of this

I have not seen many others that have stayed in the US while waiting an interview date. Do you anticipate any trouble at the interview because of this? I spent 2 days under 6 months in the US with my wife over the winter and now have my interview tomorrow. March 26. Has anyone else spent this long in the US?

How was your interview? Hope all was good!

I highly doubt you will be denied because of this. If asked, explain that you got into an accident. You should also have disclosed the denial on the application.

Interview went well! I'll get a review up in the next couple days. Got asked maybe 10 questions. Same basic ones as everyone else. The one of interest might be she asked if I'd traveled in the US in the last 5 years and what the longest stay was. I said yes and the longest was 6 months. She then asked if that had been over covid and I said yes. She said ok and that was it.

thank you. we did disclose that I was denied entry due to the overstay and then explained the motorcycle accident as the reason. The closer I get in the cue for an interview date, the more stressful it is becoming. I am so grateful to have found this site

Oh so they specifically said it is because of the overstay? Even though you were admitted after you overstayed?

yes. I was given an I-275, which is basically a withdrawal of application for admission. I've looked it up and what I've seen says it doesn't ban me from future entry to the US, and because I overstayed less than 180 days I am allowed to re-enter the US, but it is up to the discretion of the border agent if they want to let me in, regardless of our accident or not

Oh I see. It is crazy how much discretion those officers have and it literally depends on their mood and what they decide to make a big deal out of. Im obviously no expert but I really dont think this will lead to a denial 🙂 I wouldnt stress too much.
Let us know how it goes. I have a denial on record too not for overstaying but not having enough ties to Canada etc and one officer denied me and the next admitted lol. So much inconsistency.
