You're missing the point, if she can make it to the border she cannot be denied entry. Via land, you get to the border yourself. Via air, you need an airline to carry you and they aren't under the same obligations as an IO to allow her to enter, so they can refuse to take her there. If you found an airline willing to overlook the lack of documentation, she could do it by air.

It’s not a “loophole”, at a land port you are directly talking to CBP. An airline has to act as the first screen and as mentioned above they get the liability of cost of sending you back if you didn’t have acceptable documents, and the airline cannot judge a copy of a citizenship certificate. You’d find the same “non loophole” would work at airports that have CBP preclearance because CBP can check it right there and then.

Two updates:

 

1. We were able to apply for a U.S. passport earlier this week with a copy of her certificate and a printout of an email from the national passport center stating it was sufficient as long as it was accompanied with her N-565 receipt. Went to our county clerk to do that. No telling if this is going to be enough or not, so will keep checking the passport site. Did pay for expedited processing, so hopefully will at least know within a month if it's been accepted.

2. Just got notification in the mail that a replacement N-565 is on the way. Completely out of the blue, nothing in the online account even mentioning this.

Mar. 15, 2021 - Notice received (USCIS will reuse prior fingerprints)

We got the biometrics notice a month after the replacement cert was delivered :)

Was your complete timeline 7 months ? Also how’s the passport application process going ? We need to apply also. And we also have a copy of the lost one.

Just about. Applied in August, received in February. Got the passport, as well, about a week ago.
