2019 Tax return not available and now interview!

  • If a sponsor filed an I-864 (Affidavit of Support) AND provided the NVC with proof of an IRS Federal Income Tax Extension in lieu of a Federal Income Tax Return, you must upload this to CEAC or bring the sponsor's most recent Federal Income Tax Return to the visa interview.

This is what it says in the interview letter.

The problem is my Tax file for 2019 is not processed yet. I filed for extension and submitted all papers in Sept 2020, and just called IRS and they don't have answer when I will have the transcript ready.

What should i do when they ask to upload the 2019 tax transcript or ask during the CR1 interview?

I have 2019 paystubs and w2. And even can provide the employer letter saying i have been working with them since last 5 years.

The instructions tell you exactly what you need to do:  "or bring the sponsor's most recent Federal Income Tax Return to the visa interview."

You must  provide either the 2019 tax transcript or the complete 2019 tax return and supporting documentation(W2s, schedules, etc.) for the return.  The extension is no longer valid.

Take the 2019 tax RETURN to the interview if you can't get a transcript....problem solved.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Excellent! I have form 1040 (the entire file of my 2019 tax filing which was sent to IRS). I will upload it to the NVC as well as carry that with me.

Hi,

I just want to clarify as I’m in the same boat with my interview. My spouse doesn’t have the 2019 transcript, and when I submitted to NVC the 1040 was not signed. Would it be fair to bring the signed copy of the 1040 and W2 for 2019? Or unsigned like I submitted.

I think either is OK.  I think I remember signing my copy.

This process is getting me so nervous he has a W2 and 1099 with the same employer just looking now, and I have the 1040. Someone suggested to have the 8879 for e signature, as well. Wondering if I should also get an employment letter for him.
