I am a US citizen. My newly born baby boy (in wedlock with a non-USC) does not have a claim to US citizenship because I do not fulfill the requirement of 'physical presence' in USA ( i.e. at least 5 years, of which 2 years after the age of 14).

I got two options for him to get US citizenship

1. file an I-130 petition and immigration visa

2. or file expeditious naturalisation

My husband's immigration visa has already been approved and now we are looking to move to USA. I know that expeditious naturalisation may take from 6 months to 1 year, therefore not gona take that route. However, I am not sure how long an immigration petition might take for my baby? would it be quicker than my husband's (which took about 10 months).

If I take route 1, should I apply for I-130 and immigration visa simultaneously or wait until petition is approved?

any help will be highly appreciated. Regards...

1) An I-130 does not get him citizenship but simply or eventually a visa which will upon approval provide PR status.

YMMV

A directly filed I-130 will most likely take the same amount of time regardless of whether it is a spouse or a child. How long was it for your husband?

YMMV
