NAPOLI / NAPLES Consulate Medical and Interview

Timeline

Dear friends,

Since my husband and I got married in Rome, Italy, our K3 interview is being scheduled in Napoli.

The problem is that my husband is Polish and speaks very little English and no Italian.

We do not want to fill out the $200 I-824 to wait for them to move the interview to Poland, as they say it might take up to 6 (!) months.

Do you think they might have a translator available for him?

Also, he has already done his medical in Poland - the consulate gave him a list of doctors, and told him that he doesn't have to wait for Packet 3 to request it, since the medical is valid for one year.

Will he have to go through another medical in Napoli??

Thank you for any and all help you can muster

Where does your husband live, Italy or Poland? If he lives in Italy, why did he have his medical in Poland? I'm a little confused.

Who gave him a list of doctors in PL?

Just because you were married in a 3rd country (not US, not the spouse's home country) the subsequest visa interview should be conducted in the home country of the beneficiary....the foreign spouse. Why is yours being scheduled in Italy, he is Polish? Very confusing. :blink::unsure:

Yes, it doesn't make much sense.

But for some reason, they passed out a law a few years ago that states that REGARDLESS of the beneficiary or petitioner's nationality, they should be interviewed at the consulate in the country where the marriage took place.

This is for the K3 visa, not CR1.

My husband lives in Krakow, so we went to the US Consulate in Krakow, and they gave us a list of doctors that were authorized to perform the medical examination for the interview. They said that we shouldn't open the envelope with the results, and that it was valid for 1 year.

Yes, it doesn't make much sense.

But for some reason, they passed out a law a few years ago that states that REGARDLESS of the beneficiary or petitioner's nationality, they should be interviewed at the consulate in the country where the marriage took place.

This is for the K3 visa, not CR1.

Who passed this law? Maybe someone on the K3 forum can assist you, but I've never heard of this requirement. It is up to the consulate to accept the visa petition or not....and they usually accept visa petitions from citizens of the country in question, or legal residents. So if your husband is not a legal resident of italy.....it may cause a aproblem. I see on your timeline, that your petiton is at the NVC, you may want to call them and verify this.

Yes I agree, he should not be having his interview in Rome. If I were you, I'd double check to make sure its at the correct consulate. I read on VJ about people getting married in various countries and then returning home, and having their interview in their home country. Maybe somewhere in the paperwork you stated he lived/lives in Italy and that's why they scheduled there? Not sure, but definitely doesn't sound right. He should be having his interview in Warsaw. Maybe find the tel # for Warsaw consulate and ask them.

Also, I'm not sure if the CO in Italy would accept medical from PL. Why did you go for a list of medical exam places, when you are supposed to get this notice via mail... from Warsaw only. Krakow does not handle these types of visas.

The new requirement was instigated by USCIS.

Trust me, there is no mistake about this. REGARDLESS of the beneficiary or petitioner's nationality or place of residence, if you are applying for a K3 visa, your interview will take place in the country where you got married.

I called NVC and they had confirmed. Our case number also begins with NPL - for Napoli.

Then if 100% certain about interviewing in Italy, did you ask about the medical being ok from Poland?

Call Naples and ask about the translator, very much doubt that they'd have a Polish speaking person there. If he can't speak Italian, he'll have to answer in English.

Sorry, but this still doesn't sound right to me. Definitely call the Warsaw consulate.

I was just thinking about this, that's like if you got married in the US, and he were living full time in Poland, he WOULD NOT have his interview in the US, but in the home country.

Dzienki Nania, but I called NVC again, and they told me that the consulate in Warsaw won't know anything about our case, since NVC is mailing it to Napoli! These are the rules! And I'd have to call the Napoli consulate to see if they will accept his Polish medical or not. And they in all likelihood will NOT have a Polish translator handy for his interview.

I meant to call the Consulate in Warsaw to tell them about the Naples interview and ask if this is appropriate given he lives in Poland, not to ask specific info on your case, because of course they would not have this.

USCIS would not make such a requirement as the K-3 visa is the jurisdiction of the Department of State, not "Immigration". I may be wrong here...but on the I-129F, which you filed after the I-130, there is a question regarding Consulate Preference (where you would like the visa interview to take place). Did you write Napoli, Italy in that box? That may be why your NVC# begins w/ NPL. Otherwise, these petitions go to the home country of the beneficiary. Where the marriage took place (as long as it is a legal marriage) has no bearing on where he/she interviews for the visa. The place of legal residence is the deciding factor. I think you definitely need to do more checking.

There will not be a Polish speaking interpreter available for your interview in Italy.....that is not the consulate's policy. They 'conduct business' in English or the language of the local country. Acquiring the appropriate interpreter, if necessary, is the job of the visa petitioner...and it may be no guarantee that the consulate will accept this.

No, I did not indicate Napoli as a consulate of preference. I did specify Rome, but I was told that if I didn't specify the country of marriage, it would take a lot longer for processing, and it would end up in Rome, anyway.

I think there was even a forum here about this requirement. If I dig it up, I'll post the link.

I would not be making it up, as this route is much more inconvenient than we could have hoped!
