i-751 Rejected For Incorrect Payment - How Should I Mail Back My Package?

Hello everyone!

 

I filed for ROC around early/mid-November 2020, about two weeks before the expiration of my resident card. With this package, I submitted a check for $760. The new amount listed here https://www.govinfo.gov/content/pkg/FR-2020-08-03/pdf/2020-16389.pdf (page 4, near the bottom) which I assumed was in effect. I now realize I should have sent two checks for the fee listed on the i-751 page, one for the $565 filing fee and one for the $85 biometrics fee.

 

Of course, I only have realized this after receiving a NOA rejection notice just today. It lists the reason for rejection due to 'the payment amount is incorrect, or has not been provided', along with my original check stapled to the notice. Underneath the NOA is also a green sheet of paper explaining that 'your rejected benefit request will not retain a filing date. You may submit your benefit request as a new filing if you are able to correct the issue that caused the rejection.' This green sheet also says 'if you do submit your benefit request again, please enclose this letter with your submission.' Additionally, the green sheet underneath the NOA also says:

 

'If you do file the benefit request again, please note the following:

 

-Since your submission was rejected, it is not yet considered properly filed.

-You must meet all requirements as of the date of the new filing.

-Please review the relevant form instructions to determine if your new filing can be considered as timely filed.'

 

I'd like to add that my entire package (minus the cover letter) has been sent back to me with the NOA. I notice that each page of the application and my supporting documentation is stamped with a long chain of digits and a name at the end. The original USPS mail package was also photocopied by the caseworker and attached to the back of my package. They sent me back the clippings of the original USPS mail package that they cut up to photocopy, as well as the sticky notes I used to separate each section of my ROC, except they are now bundled and stapled together with the USPS clippings.

 

So, I know that I need to 'resubmit the application/petition package with the appropriate fees, and include all required supporting documentation' (as stated by the NOA). However, I just have some questions retaining to how exactly I should go about resubmitting the ROC:

 

 

  1. Can I write the new checks, remove the old check, and resubmit the package they sent back to me (with the NOA)?
  2. Do I need to include a new cover letter, explaining that I have included the corrected payment amount?
  3. Because my resident card expired in November 2020, do I need to include a letter of explanation as to why my package is technically being filed late?

1 check for $680 will do. And yes send a new cover letter explaining that you were rejected due to the wrong payment and send along a copy of all the paperwork they sent you. Do it ASAP!

I got the exact same notice today after mailing our I-751 in about a month ago..

 

I included a G-1450 Authorization for Credit Card Transaction with my submission for $595 (I didn't add the $85 since we have already done biometrics in the past) and it was kicked back.. possible reasons for rejection I'm thinking of:

  1. credit card was declined (unlikely)
  2. amount is incorrect because should have included an extra $85 for biometrics? current fee(s) are $595 + $85
  3. some other reason I'm not aware of

I've tried calling the contact center and using their emma bot, both are designed to not let you get to a live agent, I'm not sure if there are any other contact paths to verify why it was rejected. Two questions for the VJ community:

  1. does anyone know if it was rejected because I should authorize $595+$85 ($680) total instead of $595? If so, does this mean my wife has to physically do biometrics again?
  2. Do I need to re-print all of the documents including the I-751 and supporting documents since the copy they returned has the string of digits from the automated document intake machine, or can I re-use the original submission documents?

Luckily we're still in the filing window, so a resubmission will not be late. Thanks in advance for any input, much appreciated!

You have to pay the biometrics fee regardless of whether biometrics was done in the past. Biometrics can also be waived later on, but you still have to pay the bio fee + filing fee ($680). So that is why it was rejected. 

 

I believe it is usually suggested that you reprint everything and send them "clean" copies.

I also file my application on 12/15/21 with $680.00 and they rejected my file and send me back they said it’s incorrect fee so could you tell me how much is correct fee ?  Do I need send two different cheque one of $595 and one of $85 because before I sent in one cheque $680.00 and my daughter born in 11/02/2021 she is only two month old and she have not passport but I put her information in the application in child information part . So do I need to add her biometric fee too or not ?

Your application might have been returned because I’m pretty sure that you marked your daughter as “applying with you”, so she’d need a new biometric fee. If your daughter was born in the US, she’s already a USC, so you’d still list her in the form, but choose “no” where it asks “is the child applying with you”.

Yes she born in US do I need to give her information in the application or I need to skip the children’s information part ?

No, you don't skip her. You list her, but where it says "Is the child applying with you?" you would answer "no" because she is already a USC. If you answer yes, they are going to expect her to do biometrics and apply, so they would reject you for wrong payment if you only pay $680.

Yeah , I’d put “yes” in this question now I will change it by “no” answer . So then $ 680.00 fee will be correct? And before I sent them cashier cheque can I send them that cheque or do I need to new cashier cheque? And thanks a lot for helping me . I hope this time they accept my application.

I figured that was the issue. Get a new check.
