Dropped the ball - Evidence of Support

Hello all,

 

I'm petitioning my fiance for a K-1 visa and she has her interview scheduled this Thursday.  When going through our final checklist last week, she realized that we must have misplaced our original copy of my signed I-134 form I had completed as part of our Evidence of Support.  I immediately filled out a new copy on Friday and sent it via DHL to my fiance to arrive at the earlist possible opportunity, which is unfrotunately the day AFTER her interview.  So not I'm wondering if it would be best for her to attend the interview THursday as scheduled, or try and reschedule to a later time.  

 

If she proceeds with the interview Thursday, this is what she will have available as evidence:

 

  • Copy of I-134 form with digital signature only
  • Copy of my U.S. Passport to indicate U.S. status
  • Copy of final 2020 paystub with Year-end totals
  • Copy of first 2021 paystub
  • Copy of 2019 W2 (2020 is not available yet)
  • Copy of 2019 Federal Tax Return
  • December 2020 Checking Account Statement
  • December 2020 Savings Account Statement
  • December 2020 Health Savings Account Statement
  • December 2020 Roth IRA Statement
  • December 2020 401k Statement
  • December 2020 non-retirement Brokerage Statements

In addition to whether it would be better to proceed Thursday or postpone.........are there any other documents that may be suggested?  I saw some individuals have included letters from their emplyoer which we did not do, however I could contact my comapny's HR department on Monday to get something quick if necessary.

Scan, email print locally.   It will be there in seconds.  If your income is sufficient,  don't worry about all the other stuff

An employment letter would be a nice one to have, in my opinion.

This may be forwarded to her by email with the revised I-134 form.

CrisBR.....when you say revised I-134 form, are you referring to a copy of the original?  If so, it sounds like the consesus between you two would be to e-mail the I-134 to my fiance for her to print and bring to the interview as opposed to delaying and waiting until the original copy arrives, correct?  

 

I will also get an employment letter as you suggested.

That’s exactly what I mean. 

You may scan both, form I-134 and the employment letter and forward them through email.

Don't reschedule. You don't know when she could get another interview, it could be months at some embassies. If they need an original she doesn't have she can submit that to the embassy when she gets it.

Yes. Odds are a printed scanned copy is sufficient. https://travel.state.gov/content/travel/en/us-visas/visa-information-resources/visas-news-archive/20161228_ink-signature-no-longer-required-on-affidavits-of-support.html "This improvement will simplify the submission of financial evidence in support of a visa application, and decrease the rate of visas refused only because the required documents were not available at the time of the visa interview."

This specifically addresses the I-864.   One would think it would also apply to the I-134,  but a few rogue consulates have been reported to still exist.

I agree with all the above responses.  Don't reschedule anything, send the documents via email for printing locally, and if for some reason the consulate demands originals, your fiancé would most likely get a 221G for the originals which are already in transit.

You now can have a signed copy of the I-134 for the interview.  

 

I would go ahead and stick with the original interview date.  Who knows how long it would be before another date can be scheduled, and plus this is the moment both you and your fiance have been waiting for! Best of luck!

Embassy's are highly inconsistent in what they want specifically for the I-134.

 

Warsaw did not require a signed "original".  A scanned and printed one was fine.

 

I have seen another embassy (forgot which one) that did require a signed original.

 

Some want the back up documents, some don't want them (Warsaw didn't even look at them and didn't take them).

 

So, don't worry to much and take that huge list of stuff you mentioned above and it should be okay.  If they say they need the wet signature version (original), then tell them where it is and they should AP you and wait for it.

I didn't know about all of these documents, i mean do i really need to have all of these for my k1 interview?

I know about I-134, passport and tax. But others..?

Thank you so much for the replies everyone.  I'll go ahead and proceed with the interview as scheduled........apologies for so many questions, but we've been feeling a surprising amount of pressure and stress with this process.  Finding this community of helpful, compassionate people has been nothing short of a gift.

I think my list was probably a little excessive;  I purposely included any document that contained information referenced in my I-134.  So the reason why all my bank statements are included is to justify the dollar amounts I entered on the I-134 under the Income and Asset Information.  There are also boxes on the form that also ask for value of personal property and/or real estate holdings........if I owned a home then I probably would have included a copy of the deed.  Again, I think it's probably a little much but I just wanted to ensure my fiance could justify any of the answers on the form with back-up documentation.

You're interviewing in a country that is not hard to get a visa at. It's rare that someone gets denied a K-1 visa unless of course if the beneficiary and or the petitioner have misrepresented their case. Many embassies don't scrutinize the I-134, Affidavit of Support and so it's normally a formality than anything else. Good luck and stay engaged in the process. 

 

BTW the bank statements can be just the cover page that shows the beginning balance and the ending balance for the month. It doesn't need to have all the backup pages. Like this.
