Process to petition my non immigrant girlfriend faster? As a greencard holder or working visa process

From what you have said you do not meet the requirements for a H1b, interested to know how the Lawyer intends addressing that.

I am really confused on what to do as I really did not plan on taking my fathers offer, but I thought really hard as the way that he is happening on my life , I might not be able to achieve what I want until I get a lot of experience in my job. It is also hard as my girlfriend is a chinese which I need to prepare so I can properly talked about the future of their daughter. For me as well I really want her to come with me as soon as possible.

I've given you the best advice on the fastest way for you and your girl to immigrate to the US.  A work visa is not the path to quickly immigrate to the US.

I don't think a lawyer will be involve? As far as I know the boss of my father will do all the work.

Well very odd, not sure I have seen an Employer do one, they let the Legal team do it, so he does these regularly?

Sorry to say then i think it is unlikely to succeed. Big companies have their own immigration lawyers to deal with work visas, smaller companies hire ones on an as-needed basis. H1B is not just a case of signing a form and submitting it. There is a lot of stuff that has to be done and done in the right way. Unless your father’s boss has done a lot of these himself, it is a big task to ask of someone unfamiliar with the process.

Sorry, I do not know really if he has a legal team to do it. Maybe he has if it is needed. I really do not know the process but my father told me that fellow fiipinos almost gets approved when he petitions them.

This is what is going to happen if you get an H1-B non-immigrant visa, marry your girl, and come to the US.  After 6 years of you working here and her not being able to work at all, you both would need to return home to wait for the petition your father filed to become current.  In the F3 category, you would need to wait an extra 10 years versus immigrating in the F1 category.  The current PD for F3 is March 1, 2002 vs the current PD for F1 is Jan 1, 2012.

 

Take my advice.  I am trying to save you from making a BIG MISTAKE.   Wait patiently for your PD to be current in the F1 category.  Live with your girl.  Have babies.  Just don't get marry.  After you get your immigration visa and immigrate to the US, you can return home after getting your visa stamped and marry to petition your wife.  

 

6 more years in F1 which means 6 more years living in your country or 16 years in F3 if you get an H1-B and marry to bring her to the US with you which means 6 years maximum in the US, then returning home to wait another 10 years.

So if it’s a regular business it’s interesting what they mean by “most” get approved, regular H1B is awarded by lottery and generally around a third get picked, and the lottery is slightly weighted towards those with masters degrees. So statistically it would be quite surprising for them to have “most” approved when in general “most” who apply for h1b don’t get picked. 
 

In any case. Please re read what people have been telling you about what the effects will be if you decide to marry your girl and come in on H visas. Short term gain for long term pain. On the other hand if you’re happy to earn dollars for six years then go home and wait another decade for a green card, then that’s the route for you.

Just chiming in to say that, by OP's own admission, his father has been incorrect before about the immigration process, and so should take his father's statements with more than a grain of salt. I would advise OP to listen to the posters on this thread, and continue to do his own research, without relying too much on what his father said/what his father said his boss said.

Not to OP, but I imagine the employer would be annoyed if they go through all the expense and paperwork of H1 and then OP just decides not to do it, could make father’s position at work rather uncomfortable. Imo better they decide upfront if they want to pursue this or not.
