just sent out I-130, could I travel on -1B

Timeline

I just sent out my I-130 and I-485 yesterday. I didn't apply for AP because I was told traveling on my H-1B is acceptable even though I'm applying to adjust status.

Is this true? Is it safe for me to travel during July 5th-Aug 3rd before my H-1B expires on 09/30/07? I really don't want to risk this - but I also want to be with my families and celebrate my marriage.

Yes.

Is it safe for me to travel during July 5th-Aug 3rd before my H-1B expires on 09/30/07? I really don't want to risk this - but I also want to be with my families and celebrate my marriage.

Well the only issue will be that you will be away from your home in a period when you will most likely be getting letters from USCIS, most likely your biometrics will be in that time period, and maybe even your interview (although that's unlikely). Are you planning to be away for the whole month, or just some time in that period. Will there be someone checking your mail while you're away?

Well your husband being at home to receive and read mail makes it easier definitely. The biometrics appointment is assigned to you, but there is often some flexibility (often if you can't make the appointment you can show up on the following Wednesday). I would expect that you will get an appointment before the end of August if you just submitted your AOS, so your appointment is likely to be while you're abroad. Its definitely a risk, but not a huge one I would say.

The likelihood of your interview being before August is slim to none I would say.

same thing here, I'd like to go to Canada for two days, and just sent out the whole packet. Since I'm getting a new I-94, do I have to sent that to USCIS afterwards to exchange my old one with the one I got coming back into the US?
