I don't know.  The letter didn't say anything about the necessity of me being there so I'm not coming.  Bottom line it's not their life that's on the line.  I'm safe in Thailand.  The usa is covid central. No thank you.

You’ve avoided answering a number of the questions posed to you. Were you still living with her in the US when she filed the n400? If you weren’t she has a problem right there.  There is no particular reason for you to travel to the US now, but there are requirements that had to be fulfilled before she could file n400 based on marriage.

You're jumping the gun here. They haven't even asked you to be present at the interview, and in addition to that, almost all local offices right now are barring spouses (or anyone except lawyers) from joining the applicant at the interview because of Covid. I suppose there's a rare chance if they were extremely skeptical and suspicious that they might ask the spouse to attend, even during Covid.

 

Let's say they are suspicious. Here's what I think will happen: your wife will go to the interview alone, then because they suspect possible fraud or have issues with her living arrangements and spouse being abroad, they will put her into "decision cannot be made" and possibly come back later asking for more evidence or for you to come to an interview way in the future after Covid. They're not required to make the decision speedily if they suspect something. We've seen people here who've had N-400's pending for years for various reasons. She could also get denied outright if USCIS feels the requirements for marriage based naturalization were not met.

That's cool.  There is nothing sham about our marriage.  I've been married for 5 years.  I have had both of my parents die of respitory ailments and I'm 62 and I don't want to live in the usa with covid ravaging the country.  thailand takes extraordinary means to stamp it out.  It's virtualy non existant even with a second wave.  They stamped it out immediately.  I don't want to die or end up scarred for life. Ok, it's not your normal arrangements with a marriage, but we're both happy and it works just fine for us. I'm feeling confident she will be just fine.

You mention how bad Covid is here, and you fear it due to age. Is your wife significantly younger than you, hence why she doesn't have the same fears about staying in the US? Just wondering as that could be considered a red flag. Nobody is accusing you of fraud, it's just that USCIS is required to raise eyebrows at certain things, that's their job.

I hope she  is 15 - 25 years younger. Why settle for less? Sounds like the lawyer wanted this  Those that dont know its been hard to travel to or from Thailand for last 8 months. and looked risky in March with daily flight restrictions popping up... ITs a 24-36 hour trip from BKK to TX.  First time I did it at 56 I was so surprised all the 70+ year old people were alive when we landed.  Also I sometimes think with modern video tech many LDR couples talk  about more things and deeper topics  than those living together.   Good luck
