Since they took so long we had to reach out to our congressional office and they sent her a message stating “ we uncovered evidence indicating my fiancé did not meet the qualifications for this visa class at the time the petition was filed so we sent it to USCIS for reconsideration”. He’s from the Middle East

Where in the Middle East? Each country is different and some are much more difficult than others to obtain a k-1. We could give you much better answers if you stop being so vague.

Seems very odd that they would deny for forgetting to include a divorce decree. Something like that is usually just an RFE.

I'm thinking he may have been married at the time she filed.  But you're right, without the OP being more forthcoming about the situation, it is not easy to offer advice.

What does that have to do with anything???

It is very odd.

Denied for k1 visa, I already know the reason..case was just sent back to USCIS. Can I refill for k1 right away. We were in AP for over a year and I’m so upset that after all that they denied it! That’s why I’m trying to file again fast. We can’t do cr1 for several reasons. We tried before and it didn’t work out.

How did your k1 filing was approved at Uscis stage without you summited your divorce decree in the first place before your papers transferred to the embassy that you have your interview?, have to all,you will tell Uscis that you are divorce or single with out married befor or widow you will fill it the status you are befor you want to go to US to marry your US fiancee,so you sound to me like you have misrepresentation in your k1 filing that reason your k1 was denied, they put you Ap with out consular asking you for additional documents, definitely they investigate something about you for you keep in Ap for one year, so after they finished their investigation they make a decision by deny you,bec their will be a reason for them to deny u k,so do your assignment  well befor you jump in to another k1,you need to know reason you were deny befor you jump into another k1 k

It looks like USCIS missed the missing divorce decree so no RFE. Caught at embassy stage. Sent back to USCIS as incomplete (or whatever they are calling it) petition. But, like others have said there seems to be much more to this case.

It not possible Uscis to approve your k1 befor transfer to embassy, if you didnot summited your divorce decree, bec they will be sure that you are free to marry your US fiancee,I guess you have lier in one area either by talk or documents, or did yoy claim single never married before at the beginning of your k1 filing? Or you summited fake divorce decree?

We need someone with more experience than us to figure this out. I'll put a call into Tracy, he'll know what to do.

Until OP shares completely what is going on, it is hard to diagnose the problems and advise on a proper course of treatment.

Much like not sharing complete information with your doctor and expecting a proper diagnosis and proper course of treatment.

It not possible Uscis to approve your k1 befor transfer to embassy,

USCIS did not approve a K-1.   They approved the petition, incorrectly.  It happens.

We both are saying the same thing, I mean petition, that it will be approved first befor transfer to the embassy, so maybe these person has indicate himself as single never be married befor, that reason uscis dont ask for divorce decree befor his petition was approved at Uscis stage and transfer to the embassy bec I wonder why he will said they denied his k1 at consular stage bec he didn't submit divorce decree, their is misrepresentation about him which course reason for his k1 deny,my advice for him,his to know reason is k1 was deny first and I will advise him to go for cr1 not k1 anymore
