Hey everyone!

 

Just wanted to let you know that I sent my package last night to the Chicago office! 🍾

 

Thanks to everyone who answers our questions on this forum!

 

I would also like to share my cover letter lists, if you're interested in reading it.

I know that the documents depends on your situations but if you find the time, I would appreciate if you could tell me if you think that I am missing some documents, so I can prepare myself to some RFEs lol.

 

Just to give you some background, we were living in France together, my wife decided to move back to the US in October, I decided to do my green card process through consular processing from Paris, France. I still traveled with her to help her out in the first two or three months, with an ESTA through the VWP. These last weeks I changed my mind and don't want to get back to France so I decided to adjust status. Financially, my wife was a student in France and had very little income so she was never required to file her taxes. She got a job as soon as she moved paying well above the 125% poverty guideline to support us while I cant work. And that's pretty much it.

 

Here is the list for my I-130 Package :

 

  1. A check for the amount of $535.00 to cover the filing fee; 

  2. This present cover letter;

  3. Form I-130 Petition for Alien Relative;

  4. Form I-130A, Supplemental Information for Spouse Beneficiary;

  5. Two (2) photos of the petitioner and two (2) photos of the beneficiary;

  6. Petitioner’s U.S. Consular report of Birth Abroad;

  7. Petitioner’s U.S. Passport copy (All pages);

  8. Beneficiary’s Birth Certificate and English translation;

  9. Beneficiary’s French Passport (All pages);

  10. Marriage certificate copy of Petitioner and Beneficiary;

  11. Evidence of bona fide marriage.

    1. Dated Pictures of Petitioner and Beneficiary physically together since November 2018;

    2. Joint Apartment lease in Paris, France from 10/02/2018 to 12/12/2019;

    3. Affidavit sworn by the Beneficiary’s mother;

    4. Plane tickets of trips together

  1. A check for the amount of $1,225.00 to cover the I-485 filing fee and the biometric fee; 

  2. This present cover letter;

  3. Form I-485, Application for Adjustment of Status;

  4. Form I-944;

  5. Form I-864, Affidavit of Support

  6. Financial and global situation explanation letter

  7. Applicant’s Birth Certificate and English translation;

  8. Applicant’s French Passport (All pages);

  9. Applicant’s current School certificate

  10. Applicant’s current school progress

  11. Applicant’s past work contact as a Web Developer

  12. Applicant’s past work pay slip

  13. Applicant’s Electronic I-94

  14. Marriage certificate copy of Petitioner and Applicant;

  15. Petitioner’s U.S. Consular Report of Birth Abroad;

  16. Petitioner’s U.S. Passport copy (All pages);

  17. Petitioner’s Employer Verification Letter and Verification of Address

  18. Petitioner’s Work Contract

  19. Petitioner’s Pay Slips

  20. Petitioner’s Self Employment Deliveries Tax Summary for the last month to date

  21. Petitioner’s Self Employment Sales and Profit Summary for the last month to date

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

What you submitted looks good, but did you know that you could file for EAD and so you can work and travel internationally? Forms I-765 and I-131

January 15, 2020 RFE received

January 30, 2020  RFE response sent

Feb 7: EAD approved and interview scheduled

March 18, 2020 Interview cancelled

April 14th 2020: RFE received

April 29, 2020 Approved without interview

May 1, 2020 Card in hand

 

REMOVAL OF CONDITIONS

February 1, 2022 package sent

March 28, 2022 Fingerprints reused

July 18, 2023 approval

July 20, 2023 Card in hand

February 4th, 2023: Biometric appointment

June 15th, 2023: Case actively being reviewed

July 11th, 2023: Interview scheduled.

August 30th, 2023: Interview!

Did you send separate supporting documents for those forms? Remember that each form is a different application. You would need 2 passport pics for EAD, 2 more for AP. And all the other supporting documents that these 2 forms requires.

 

765 and 131 are not part of the 485 package. They are forms that can be filed at the same time as the 485.
