I got the vaccination after my K1 approval because I don’t want to do it in the USA. I think my DS3025 is still valid because I will be applying my AOS within one year of my medical? 
 

 

You don't get to choose to "use" the copy you have. USCIS will receive the original that is in the sealed envelope after you hand it over at POE. They will see that your DS-3025 is not complete, as the original that they will have in your case folder is not complete. They don't care about the copy that was changed afterwards. You will likely have to get the i-693 to complete your vaccinations once you're inside the US.

Vaccinations is not a requirement for the visa to be issued. The whole purpose of getting vaccinated during the foreign medical is to use it for AOS.

 

The physician you went to made a mistake by not giving you the vaccine when you first had your medical, and also made the mistake of wrongly marking you completed the vaccination requirements. Since vaccines are not a requirement for the visa to be issued, your visa was issued with no problem.

 

After saying that. Having the physician to sign a new DS3025 that is not going to be on the sealed Do Not Open Package is worthless. USCIS needs a original form signed by the physician in a sealed envelope and you don't have that, you only have a photocopy.

 

You don't have to take the vaccine again, but you need to find a civil surgeon to complete a 693, IF the officer looking at your case finds out that the DS3025 was incorrectly filled out.

So are we talking about the medical exam for the interview in your country? If so, how did you come to have a copy of the DS-3025, Vaccination Documentation Worksheet?

Everyone gets a copy of the DS-3025, the doctor/clinic should always give you a copy. If they forget to, you need to ask to get one. According to VJ, applicants are recommended to send this copy with the AOS package for some reason, but USCIS obviously goes by the original, with the original signature etc.

I am aware of the path that the DS-3025, Vaccination Documentation Worksheet takes in this process. What I don't get is, whether the OP is speaking about the medical exam in her country or afterwards. Terminology can be misconstrued during this process. My question was only to get clarification as to when she came to have possession of the DS-3025, Vaccination Documentation Worksheet. It makes a world of difference when filing her AOS

She had the vaccine in her country after the visa was already issued. The one who gave her the vaccine only made a change on the photocopy she has, the original is still without the latest vaccination and sealed in the envelope she will hand over at POE. She believes it's enough that the photocopy has the last vaccination on it.

- OP had the medical before the visa interview and didn't take the MMR vaccine. Panel Physician incorrectly marked the DS as completed.

- OP gave the consulate the medical package. Visa was issued.

- After the visa was issued, OP decided to take the MMR vaccine with the same panel Physician, and they filled out a new DS 3025 with the MMR. Physician gave him a photocopy of that.

- OP wants to use the new DS3025 to prove at their AOS Interview that they completed the vaccination requirements.

- The issue: the original DS3025 in the sealed envelope doesn't show the MMR and that's what matters.

Thanks for the information. The OP can use the new DS-3025, Vaccination Documentation Worksheet if the original is marked so. If not, they should have the PP from the medical facility create a "corrected copy" to the embassy to be included in the packet. Otherwise, it won't be valid and/or at best be questioned by immigration during the AOS phase. Just my thoughts.

Timeline

I think everyone is very confused on my case and I am just as confused. So here's the list of my situation:

 

  • 10/6/2020 (Malaysia): When I first had my medical exam, they couldn't provide the MMR vaccine because it was unavailable at that time. So the original DS-3025 put "D" in the blank waiver because it was unavailable. But my worksheet is marked as "completed vaccination".
  • 11/10/2020(Malaysia): Had my K1 visa interview
  • 12/9/2020 (Malaysia): Got my visa in hand
  • 01/8/2021 (Malaysia): Went back to my panel physician (in my home country) to get the MMR vaccination that was not available during my medical exam, the doctor gave me the MMR shot, and 2021 influenza shot. The clinic told me to bring along the photocopy of my original DS3025, doctor added the vaccination date and include the new 2021 inflenza shot in the PHOTOCOPIED DS-3025 (the photocopy of the original DS-3025/ not a new one). And told me that this should be ok for my to apply AOS (not so sure about this now after seeing the replies). 

Sorry if this is confusing but I am confused myself as I have just finished my K1 proceed and this AOS proceed is all new to me. 

 

So since I got the vaccinations I needed, my question now is:

  1. I can't use this updated photocopied DS-3025 to apply for AOS?
  2. Since I already for the vaccinations I need to apply for AOS in my home country and certification from the panel physician, do I get civil surgeon to transcribe Form I-693 and apply AOS with the Form 1-693 instead?
  3. If not what is my solution?

You are definitely overthinking. 

 

If you' were given a waiver at the medical and the sheet was completed. You don't need to do anything else. You didn't need to take the vaccine afterwards.

 

From the USCIS website:

 

"4. Vaccines Not Routinely Available Abroad

“National vaccination shortage” principles do not apply overseas. In the context of overseas vaccinations, the term panel physicians use to indicate the unavailability of a vaccine is “not routinely available.” Therefore, if the adjustment applicant is permitted to use the vaccination assessment completed overseas, [11] then officers should not find the applicant inadmissible solely based on the lack of the vaccine(s) that is “not routinely available.” Officers should also not issue an RFE for corrective action. USCIS will grant a blanket waiver in these cases."

 

So you don't need to find a CS. You didn't even need to take the vaccine.

Oh no! Will this updated copy of DS-3025 get me in trouble in the future? 

 

Do I need to submit anything to prove my vaccination record during my AOS? Since I don't need to see a CS and obtain Form 1-639.

You will give your original medical to the POE officer.

 

You don't need to send the DS 3025 with the AOS package. This is not a requirement. Some people send it to make sure the officer reviewing the case knows it was already done.

 

I would not send the copy you have. The panel Physician made a huge mistake of adding vaccines that were taken after the form was originally signed. How can you have on the form a vaccine that was taken in Jan 2021 and the form was originally signed on Oct 2020? The officer can easily think you edited the sheet yourself to add that.

 

You should ask the physician for another form of proof that that vaccine was taken.

I can’t believe the panel physical screw me up like that. I didn’t know any better! 
 

what is the best form of proof of my vaccinations the panel physical can provide? Since the photocopied of the original is tampered.

@Ayrton since my DS-3025 is tempered, would it be a good idea to visit a CS in the US to have a form I-693 to show my vaccination record? 

 

I can't believe this actually happened and the panel physical was casually editing the DS-3025.

At least I know now im good to go. Can't believe she actually tempered my photocopies DS-3025. What are the chances that panel physician will have another copy of my untempered DS-3025? If they don't have, what are the best form of proof to show that I have done all my required vaccinations?
