I had submitted our k1 visa paperwork to Nebraska on February 21, 2006. I was notified by my U.S. Michigan Army National Guard unit that I was being transferred to a different unit that is preparing to go to Iraq. Well this is where the problem resides, a group of us are on "alert" status for Iraq, I have yet to receive my orders but we are training for the mission and supply is coming through very promptly for items that would normally take months to receive.

I contacted my congressman, his office submitted the emergency expedite paperwork back around March 14, 2006. Anyone know of my chances to bring my fiancee and her daughter over from Guangxi, China to the United States prior to my deployment scheduled for July 2006? I have a home set up for them, family members within minutes (my sister lives across the street from me) from our home. I would love to start a family with my fiancee (soon to be wife, I hope) prior to the deployment. I'm 43, my fiancee is 39, we both would like another child before we get older.

Anyone know of anything else that could be done to expedite the k1 visa process?

I believe what you have already done is the best way to expedite the (otherwise slow and painful) K1 process. Is there possibly someone you could contact with JAG, as well?

Well as of this moment I am still a "civilian soldier", what this means is that I have to be prepared for almost anything at a moments notice. Being "part-time" military I'm not entitled to the privilages of JAG, though I may be wrong, I'll contact my unit to see what more can be done. We're on "alert" orders for the deployment, I'm sure that if the "true" orders were cut the emergency expedite would be a sure thing. By the time that the actual orders will be cut this leaves very little time for the USCIS office to act upon the request.

The bad thing about this is that me and my fiancee want to start our family before I get deployed, if she's not here before my deployment this will risk our chances of conceiving and having our baby by waiting the additional 1 - 2 years. It would be nice if a law could be established whereas military members can have a proxy for marriage purposes, this way I could marry her while serving my country in Iraq. Doesn't help in conceiving and having our baby but sure would help knowing that I was finally married to her not just in our hearts but also on paper.

Have you tried contacting your Senator or Congressman?

Although I didn't actually try to expedite Pras' K-1, I found that there was an issue about her mum's wish to attend the wedding (a very big issue amongst desis). I contacted the offices of (retiring) Sen. Sarbanes and Congressman (running for Sarbanes' seat) Cardin over the last month.

Cardin's office phoned me this morning stating that they had emailed the Delhi embassy last friday, and were still waiting for a response.

Well as of this moment I am still a "civilian soldier", what this means is that I have to be prepared for almost anything at a moments notice. Oh I see. Well, I would still contact your unit and see if there are any other avenues available to you (that they know of). These days, 'alert' orders can turn into 'actual' orders pretty quickly. And hey, 'part time' military still counts in my book. :thumbs:

I would say it's a canned response that says they're not going out of their way. :wacko: Can you not get your fiancee over for the 3 month visitor thing?

Thank you all for the response to my post. Hmmmm, tell me more about the 3 month visitor thing? Would this jeopodize our K1 visa? What would happen if we were to get married if she is here on the 3 month visitor visa? I need specifics please.

Yesterday I saw a post/timeline...they got their k3 visa in about 1 1/2 months from the date of their NOA1.

I hope you get a speedy processing. :)

By the way can not you meet halfway in Iraq? I do not think Iraq has a stringent visa policy. It does not even have a viable government apart from the occupation arrangements.

I am now a US citizen.

I am sure the US Army does not allow families to be deployed to a war zone.

Also the chances of getting a Visitors Visa (6 months) in these circumstances would be remote to say the least.

JAG has been mentioned, that would be the best bet. Generally USCIS does go out of its way to help Military connections.

I do not know if your current situation permits you to travel, but a visit to China would seem easiest.

The only time I saw the consulate in Montreal expedite a K-1 visa interview was for a couple where the USC was due to be deployed. Not sure if you will get the same consdieration from the consulate you are dealing with, but it can't hurt (when you get to that part of the process) to ask for an expedited interview date.

You mentioned something about a proxy type wedding in the unfortunate case that you aren't able to expedite things quicker. I think this might be possible somehow... I can't remember too many of the details, but a few months ago I read a newspaper article about a couple who got married over the internet and webcams... they had never met in person but had been carrying on a relationship for years. Like I said, I can't remember the details so I am not that helpful, but I do remember reading that they had been able to legally get married in different countries. Maybe you could look into this?

I have already checked into the proxy wedding. This is an option IF both are already U.S. citizens. It's amazing that two people that have not ever met can have a proxy wedding but for someone that has met, has had an ongoing relationship, the proxy wedding cannot happen because of the geography of the one soulmate???? It does sound like the emergency expedite is possibly being processes, we shall see.

I had my drill weekend this past weekend, actually a four day drill weekend, training up for Iraq. We had to attend a briefing / class from the Rentention NCO (the people that the military re-enlist with). Towards the end of the class they asked if anyone had any questions about retention, re-enlistment, or any legal issues, at this time you better believe I saw them. I told them about my situation, how I have "aler" orders and not actual "deployment" orders and that I was trying to get an emergency expedite of my k1 visa. They took down all of my information, they said that they would pass it along to JAG.
