to the OP

with all the above from VJ members,  you say you need him to help

but will he stay after getting his green card and a job???

or leave you and divorce and do his own ROC and later citizenship to bring a wife and child here

you would not be the first one this has happened to

and i really am so very sorry you go thru the illness and all this heartbreak /  no one deserves this

This is quite common in the immigrant community from west Africa. I have also examined district court documents covering several cases of such fraud. Unfortunately it is the beginning of a shipwreck.

All I will say is get a great immigration attorney but don’t get your hopes up. For encouragement I know of at least two cases where immigrants were convicted of marriage fraud after becoming citizens and although the citizenship was revoked, immigration declined to pursue revocation of the permanent residence. Those are different from your case however I cite them as evidence that it is not over until it is over, although your case indeed appears quite hopeless.

So your making the statement that its common for immigration fraud from people in West Africa... and then people take shots at immigration scrutiny for countries like this!? I for one am happy that they scrutinize those people and should continue to do so... and remove anyone that used fraud to gain access into America!!

To those saying the marriage is legit regardless, I wouldn't be so sure. The lies were on the marriage license/certificate as well.

I'm with you... I hope he gets deported... he should have never been here in the first place since he came here based on lies...

Would be nice if the OP would come back to answers our questions.

Why ask for help and leave everyone hanging? Leads me to think that there's much more to the story like perhaps the OP knew all along and now she's just looking for a way to get around all the lies. Just a hunch.

Yep. In fact op treats husband as “the guy” and talks about how he’s supporting them. I get that you might call husband “this guy” when you’re mad, but looks fishy

Calling your child a cripple and your style of writing makes me believe you’re didnt grow up stateside. Tell this guy that the gig is up. Maybe he should look at walking across the border into Canada and try there.

Wash, rinse, repeat. 😁🤣😁

Just another random guy from the internet with an opinion, although usually backed by data!

I am a USC married to a man from ghana in 2019. we filed for I-130, I-485 etc and after some months of submitting his paper-works to USCIS, he eventually got his EAD and starts working. This guy support me in everything that requires finances (including my bills and rents), help with my crippled daughter and I was diagnosed with type-2 diabetes which makes my health to get worse everyday. we got notice for his AOS interview in Chicago local office and after few month of waiting we got reply that my husband need to authenticate the divorce certificate he presented from ghana (NOID). At this point my husband opens up to me that the divorce cert was fake that he is never married back home and that the son he told me he had was a lie too. he told me this was the lie he presented in ghana to get visa to come here.

Now my major concern now is he presented this same fake certificate in the court to get married to me and the fake son's name he claimed is on our marriage license. Now he is ready to tell the USCIS the whole truth and not cover more lies.

My readers, what should we do ? what are the implications of this on his chance of getting his green-card? Are we still legally married if we inform the court house? because without this my husband, myself and my daughter we're doomed.

Every reply and contributions will be appreciated.

All you can do is tell the truth at this point. What are the implications of a green card. Probably zero. But you do need legal representation. So many lies and the misrep fraud is already established. He got a Immigration benefit based on a lie and followed up with false documents.
on a Visitor visa he would have had to submit marriage certificate and child's Birth certificate. Hubby needs to come clean so there are no more surprises for you at interview.

When do you have to answer the NOID notice?

1 st of all so sorry this happened to you

2nd Looking at it differently

if he had to produce a fake divorce degree,  he was married

i know Ghana is a  3rd world country but they still register marriages

3rd he would have had to show proof of the child to embassy (not just tell them)

if the above is true,  she wouldn't be legally married

i would kick his butt out and see an attorney to protect you

tell him he needs his own immigration attorney

and i would inform immigration of the fraud

You would be surprised how many get fake divorce certificates and even marriage certificates to perpetrate a lie. One of the reason why Nigeria for instance is Banned until they clean up their act.

Many just lied to think it means they have strong ties and some really are married but need them fake papers to get over.

I find it a bit surprising that in all their relationship there weren't photos or Skype calls with this child? How can someone make up a child? He didn't send money to them? Talk about them? Their family never mentioned them? I hope it's not the case that he did get married and had the child, but never divorced.

I agree that there should be a lawyer involved. "Coming clean" like some people are suggesting is going to get him deported.
