The third world designation is not only anachronistic, but also considered demeaning by most people from such developing countries.

The term Third World was originally coined in times of the Cold War to distinguish those nations that are neither aligned with the West (NATO) nor with the East, the Communist bloc. Today the term is often used to describe the developing countries of Africa, Asia, Latin America, and Australia/Oceania.

and not meant to offend anyone/  its not my term

i am married to someone from one of these countries

just pointing out the country is more moderized than most think and marriages and other documents are registered

Now my major concern now is he presented this same fake certificate in the court to get married to me and the fake son's name he claimed is on our marriage license. Now he is ready to tell the USCIS the whole truth and not cover more lies.

To those saying the marriage is legit regardless, I wouldn't be so sure. The lies were on the marriage license/certificate as well.

1 st of all so sorry this happened to you

2nd Looking at it differently

if he had to produce a fake divorce degree,  he was married

i know Ghana is a  3rd world country but they still register marriages

3rd he would have had to show proof of the child to embassy (not just tell them)

if the above is true,  she wouldn't be legally married

i would kick his butt out and see an attorney to protect you

tell him he needs his own immigration attorney

and i would inform immigration of the fraud

He knows exactly what he is doing. Faking thru love, Until Green card.

For once, getting an annulment on the basis of fraud is very possible in this case. OP should check state law on that.

Yep.  I would like to see what other red flags exist in this case....age difference, etc.

I hope an annulment will be possible. Unfortunately, OP, despite discovering the fraud, seems to be highly dependent on the husband. So it may not be an avenue they are willing to take.

Not gonna lie, but if I were in OP’s shoes, to me that would be a dealbreaker on the marriage, lying about having a kid and a previous marriage— those are huge relationship bombshells to drop. Forget USCIS, even if it was a domestic marriage stuff like that would make me wonder what else he was lying about. Why wait until he was caught to tell the truth? Probably because he is actually trying to commit green card fraud.

I’m sorry about all this, OP.

You forgot Kenyans.

Infact, I just wrote about this last month.

I am a USC married to a man from ghana in 2019. we filed for I-130, I-485 etc and after some months of submitting his paper-works to USCIS, he eventually got his EAD and starts working. This guy support me in everything that requires finances (including my bills and rents), help with my crippled daughter and I was diagnosed with type-2 diabetes which makes my health to get worse everyday. we got notice for his AOS interview in Chicago local office and after few month of waiting we got reply that my husband need to authenticate the divorce certificate he presented from ghana (NOID). At this point my husband opens up to me that the divorce cert was fake that he is never married back home and that the son he told me he had was a lie too. he told me this was the lie he presented in ghana to get visa to come here.

Now my major concern now is he presented this same fake certificate in the court to get married to me and the fake son's name he claimed is on our marriage license. Now he is ready to tell the USCIS the whole truth and not cover more lies.

My readers, what should we do ? what are the implications of this on his chance of getting his green-card? Are we still legally married if we inform the court house? because without this my husband, myself and my daughter we're doomed.

Every reply and contributions will be appreciated.

It seems to me that he lied in order to get the B2, which was successful.  That sounds like possible material misrepresentation.  After marrying the USC while in the US via that B2, he applied to adjust status.  I guess he filed the fake divorce decree as part of his I-130/I-485 package to cover the previous fake marriage claim.  USCIS caught the fake, and demanded authentication of said fake.  A NOID/NOIR was issued.  That's the way I read the OP posts.  I see trouble from a couple areas- Possible material misrepresentation in obtaining the B2 (from which he later attempted to adjust status) and willful misrep again by knowing submitting a fake document to USCIS.  This may or may not be exactly what happened.

I'm now thinking it's possible that he is married to a woman back home (at least unofficially) and he does have a kid but he was trying to hide them and maybe bring them to the US later? Anyway, I find it incredible how someone can lie to their spouse about a child. Did OP never ask to see his kid? Pictures of the kid? Financial support? Sending gifts? I just don't understand.

That crossed my mind, too.....which is fraud from the very start......fraudulent marriage as well as visa fraud.

Op has been back but not clarified the situation so my guess is that we will never know.
