This isn’t true. I’m the August 2020 K1 AOS filers, someone received their EAD despite a pending RFE.

Maybe it's changed. As I said in my previous post, my AoS was back in 2017. I had an RFE too and I distinctly remember that people here said my EAD/AP would not be approved until after the RFE was responded to and cleared.

I don’t have it in front of me, but it said that we had either used an outdated form OR my wife needed to provide a long form birth certificate. The weird part is that we did have any outdated forms and we did use her full birth certificate the first time. We resubmitted everything the same as the first time, making sure all the forms were up to date and her birth certificate was right. But it was an RFE. It was really confusing to us.

Usually they flat out reject an outdated form, but can if they choose send an RFE. This leaves me to wonder if you had received a receipt notice yet? Since they will not respond to a service request on a case that has not yet been receipted..

I applied for EAD April 23 2020, did my biometrics this Tuesday gone and hope to get my card by mid feb. the pandemic created a big backlog and unfortunately there is no real order to how they’ve been processing that backlog with people who submittted in July being pressed already... I do know that service requests get ignored if not outside processing times which currently April 2020.. the 30 days is 30 business days and when you call they say give it 45 days before calling them.

expidites on cases can be obtained usually from a job offer or extreme financial impact onto the usc, but not guaranteed.

An RFIE will, in fact, halt processing of an EAD.  After all, the adjustment of status application is the basis for the EAD.  I can point you to several attorney websites.  Maybe your case slipped through.
