Hi All,

 

I have searched the forums and found partial answers to my question. Apologies if it has been answered in full before, I've waited a long time for the interview and want to make sure everything is perfect.

 

I suspect I am fine but here we go. I make a decent amount over the poverty line. Only issue is I was working abroad for half of 2019 so my tax return is only 17k (roughly $100 less than the poverty line) from 2019 (I got employed in America in August of 2019). I have all sorts of confirmation of my salary now (employment verification, pay stubs, etc) but I worry a picky CO could take one look at my 2019 tax return, see 17k and deny us. I understand the I-134 is only for confirmation of the salary now but my 2019 tax return isn't ideal.

 

Should I look to  family member to co-sponsor or am I fine? I plan on attaching an explanation to the 2019 tax return along with my work visa to Uganda.

The petitioner must demonstrate to the CO that they (you and the beneficiary) will not become a public charge. Evidence to demonstrate that lies within the employment letter, current W-2's and the TT from 2019. It is my understanding that "foreign income" should be listed in the Form 1040 U.S. Individual Income Tax Return and would be considered in its totality. I am not a tax attorney, so I throw that out there for consideration.
