Hi,

 

I accidently marked I was married before but I have not been married. They sent out an RFE requesting additional information. Should I just write  a letter stating I made a mistake and have never been married and have that letter notarized?

There is nothing else you can do, but try to explain .  It is impossible to prove you were never married.  Exactly, Which question(s) did you accidentally mark?

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Oh....Now, I see it.  I would just write a letter explaining that I mismarked that box.

Hopefully you wont have to "prove" anything since you weren't married.  Don't try and sweat it though, it's a simple type o.

I have a question with regard to something similar like this on our application but I wasn't sure if I should worry or not. On our cover letter, our lawyer wrote a short blurb about 'Mr [my fiance's name] is petitioning to have his fiancee MRS [my name] to come to the USA' etc etc. I have never been married therefore never been a Mrs, it is a total typo and resulted in my telling the lawyer exactly how I felt about him putting his paralegals on the case for us instead of doing the work himself. 

 

On the actual form to the marriage question they marked no for the 'ever been married before' question. Since the cover letter isn't part of the official I-129F I'm trying to tell myself it should not matter because otherwise I'll work myself into a state and freak out. Should I worry?

NOA1 notice date: 2/27/2021

NOA1 receipt date (backdated): 12/28/2020

This is an error that can be explained away with either and inquiry coming from USCIS with and RFE (which I doubt will happen) or from the CO during the interview. There is nothing that you should do now but let "sleeping dogs lie (as in lay down)". If the CO questions you at the interview you can go into detail at that time, but again, I see at not being an issue. BUT, be prepared to address. A letter from the lawyer "admitting" to his mistake for use either if an RFE is issued or you are asked at the interview would go a long way in circumventing any dissolutions. If it were me, I wouldn't worry about it.

Thank you! We contacted the lawyer and the paralegal apologised (!!!!!!) but said it won’t affect the petition. 
 

I’ll still ask them to give me a letter of admittance later on down the track.
