Hello All,

I will appreciate your input to my case.

I was granted a in 10/01/17. This is due to expire in 10/03/21.
However, due to my USC abusive nature and in the relationship, I filed for removal of condition under WAVA in January 2019.
While, ROC was pending, I filed for N400 in September 2020.
I got notice of action (NOA) that N-400 Estimated case completion time is May 2021.
Noticing that my current status is due to expire in 10/03/21.
I phoned USCIS to make an InfoPass appointment to extend conditional PR.
However, I was told to create an account on USCIS and make a request to replace PR card.
On completion of the request, they asked why am I making a replacement request, but non of the options is applicable to me as I only want to get an extension on date.

Please help what suggest what to do to extend a LPR.

Are you saying that conditional GC was issued in October 2017?

Only an Immigration Judge can revoke your status. The date you mention is just about the card/document. You'll still be LPR after that date.

You can try again and ask again for Tier 2. Tier 1 is commonly referred to as the misinformation line. Also explicitly ask for I-551 or ADIT stamp.

Sorry about the confusion there. This is due to me picnicking about my status.

I was granted a in 10/01/17. This is due to expire in 10/03/21.

Yes, I was granted conditional GC on 10/01/17 which is due to expire in 10/03/21.
But I applied for I-751 Petition to Remove Conditions on Residence under wava in Jan 2019. While ROC was pending, I applied for N400 and just got NOA that N-400 Estimated case completion time - May 2021.

I also read here : <https://www.uscis.gov/policy-manual/volume-11-part-b-chapter-2>
A CPR is not eligible to file a Form I-90 for any reason if he or she is within 90 days of the expiration of conditional status. This ensures the CPR files the appropriate petition to remove the conditions during the 90 days before his or her CPR status expires.[12] The receipt notice for such a petition to remove conditions serves both to extend CPR status, and as proof of that extension, while the petition is pending.

Does this mean I can use my "NOA that N-400 Estimated case completion time - May 2021" Letter to travel after the expiration of my conditional GC which is due to expire in 10/03/21?
OR
Continue to apply for infopass to obtain extension of GC via i-90?

Just got off the phone with USCIS, have to call back tomorrow to speak to Tier 2 officer.
Because I am on the PST, I have to call B/W 8:00 AM and 8:00 PM EST.
The call is about making infopass appointment to extend my GR which is expiring at end of March, 2021. Sorry being a Canadian I get MM/DD/YYYY date format wrong sometimes.

being a Canadian

You're forgiven, eh. :)

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

That's not possible, CR6 is valid for 2 years. If you got it on 10/01/2017 it would have an expiration date of 10/01/2019.
However, due to my USC abusive nature and in the relationship, I filed for removal of condition under WAVA in January 2019.

You filed for an abuse waiver, not VAWA. VAWA only applies for AOS not ROC.
While, ROC was pending, I filed for N400 in September 2020.

If you divorced your USC spouse you can only file for naturalization in 2022.
I got notice of action (NOA) that N-400 Estimated case completion time is May 2021.
Noticing that my current status is due to expire in 10/03/21.

What status? Your green card? A stamp?
I phoned USCIS to make an InfoPass appointment to extend conditional PR.
However, I was told to create an account on USCIS and make a request to replace PR card.

You cannot file an I-90 if you have an I-751 pending.
On completion of the request, they asked why am I making a replacement request, but non of the options is applicable to me as I only want to get an extension on date.

Ok, so I noted quite a few discrepancies above - can you clarify if you already have your PR, when you got it and how, when the expiration date is, etc?

Just realized - did you get CR6 through VAWA? If so, ignore my post.

If the ROC was filed in January 2019, don’t you have an 18 month extension letter?  I am also confused by the dates as I would also expect a CGC to be valid for 2 years, so did you file for ROC in January 2019 or 2020.  If January 2019, that seems way too early.

OP later said that DD/MM/YYYY was used in first post. So looks like conditional GC was issued in Jan 2017.

Ok, so that makes more sense, but then the 18 month extension should still have about six months left as I believe they were still issuing the 18 month version in January 2019.

You are absolutely right. In addition,  I noticed that NOA on myUSCIS N-400 Application for Naturalization Estimated case completion time 6 months

Though I have about 6 months left in CR6 , my effort here is to prevent running out of status. I have been able to secure an Infopass appointment.

You don’t have to worry about status, you don’t lose that, but rather your proof of status expires. If you get close to the expiration of you extension letter and your naturalization is not complete yet, you can schedule a visit to your local USCIS office to get an I551 stamp that will be good for one year to prove your LPR status.

Good Luck!
