Im sending my aos paperwork soon and I was wondering, in the forms where they ask about my husbands taxes, should I leave the last tax year of 2019 he paid or 2020? My husband won’t do his taxes until February/ March cause he still needs to get his W2s. I wonder if I’m the form i864 I can leave 2019 as a last tax or I need to put 2020 and wrote a statement my husband didn’t do his 2020 yet?

You answered your own questions.

Nobody has done 2020 taxes yet, nor would you have the supporting documents.

Are you in a big hurry to submit? Because I’ve read some cases in previous years where they submitted about this time of the year and got RFE for not submitting the latest tax returns. It shouldn’t, but it definitely happens.

Well actually yes, due to my I-94 expiration I wanna send it out ASAP, I don’t know how long we’d need to wait, my husband still didn’t get his w2s

I-94 does not expire.

It is fairly common that W2s are not received until the end of January.  Also common that 1099s for other income to arrive even later.

I mean, I need to send paperwork before I’ll be out of status
