I-130 for Minor Children

Timeline

I have been trying to find a step-by-step process regarding this but I have not had any luck and I'm reaching out to Visa Journey for assistance. Help please 🙁

 

1. I am currently an LPR and already finished the ROC process. I am thinking of waiting for my N-400 window and process that first before the I-130 for my minor children. Your thoughts? My window opens April 2022.

2. I have no idea how to start the I-130 for my twins back home.

3. If approved already here in the US, what do they have to do back home? I am planning of scheduling everything here and doing the legwork for them. My mom is not computer savvy and would just like to have the interview dates scheduled and they can just travel to Manila on those dates.

4. What is the timeline that I'm looking at for this whole process?

 

Any help would be appreciated!

N400:

March 6, 2022: N-400 Filed Online

October 20, 2022: Interview (Approved)

November 10, 2022: Oath Ceremony

I130 - Minor Children:

December 20, 2022: I-130 Filed Online

November 15, 2023: Approval Notice

November 19, 2023: NVC Received

December 11, 2023: DQ'ed

September 30, 2024: Interview Letter

November 6, 2024: Medical Exam (Passed)

November 18, 2024: Interview (Approved & Issued)

You start by reading the instructions for the I130 as well as the guides.

April 2022 for filing the N-400?  Didn't you receive your conditional green card in 2017?    Your 3 years started in 2017, which means you were eligible to file the N-400 in 2020

Spouse won't cooperate for that 3 year eligibility. Have to wait 5 years now.

It's not really any of my business, so you don't have to answer. But why would a spouse "not cooperate" on this? Also, I'm not sure what level of cooperation is required for your spouse to participate in your naturalization at this point...?

Isn't it that for the interview the spouse should be there?

The N-400 guidelines simply say you're eligible if you've been married to a US Citizen or LPR for 3 years. It doesn't say anything about whether or not they support your application or interview. My ex-wife went through naturalization and I don't recall having to be involved in that process at all. The only thing that might disqualify you is if you got divorced beforehand. As far as I know, once you've reached this stage of LPR, you're free to do as you like as long as you're married. If you divorce, then yes 5 years would be the requirement. But I don't recall the spouse having to be involved or supporting the N-400 in any way.

He doesn't have to show up .. he isn't applying for citizenship.

 

Confused why he doesn't want you to naturalize.

You don't have your green card or a copy of your marriage certificate?    Marriage certificate is recorded with the county where you were married, easy to acquire a copy.

I have my green card & the marriage certificate. I do not have the tax returns for 2020 & 2019 that it's a joint filing, no lease copy, no bills, no vehicle insurance.

N400:

You would need evidence of husband's U.S. citizenship 

 

As for tax return/transcripts .. if you file jointly you can request copies from the IRS.

Extremely. Well, I only have a year left. Might as well wait instead of burning $725.
