Does anyone here has any experience filing a separate I-751 for a dependent child?

Hi

I included my son in that Joint I-751 application but USCIS returned the check for our son's biometrics with a blue letter stating that he should apply separately. This is due to the fact that I got my permanent residency on June 24, 2005 and my son got his on October 6, 2005. That is at least over 90 days.

Anyway, we should be able to send his I-751 on July 6, 2007. My questions are:

1- In regards to the Evidence of the Relationship. Should we send exactly the same set of evidence as our joint I-751 which we sent last May 2, 2007? This does not seem to apply to my son. Any thoughts?

2- If the I-751 application is received by USCIS on July 6, should the check be made out to the $275 (fee and biometrics) or should we make it out to the new amount? I read that the new fees take effect on July 31, 2007. However, I am reading that even though USCIS received the application on a certain date, they really consider the date of receipt as at least 30 to 45 days after it arrived. Or it looks like their receipt date is not the date the package arrived in the Service center. Any thoughts on this?

3- In Part 3. Additional information about you (of the I-751 form), what should my son put (Yes? or No?) in regards to question # 7 'Have you ever been arrested, detained, charged, indicted, fined or imprisoned for breaking or violating any law or ordinance (excluding traffic regulations), or committed any crime which you were not arrested in the United States or abroad? My thinking is that my son should put down Yes. On May, 2007 he got involved in a case where he and his friends parked in a No trespassing area a famous spot for troublemaker Halloweeners. They did not even parked for more than 3 minutes when the police came around and warned them about the No trespassing. The police got the license of everyone in the car. I am not sure if they were actually arrested but they were told they won't be charged since they did nto even had a chance to get out of the car. However, it appeared that on the same night (Halooween night) at least 30 other kids were actually arrested and given citations. We think that my son and his friends got accidentally included the papers submitted for actual prosecution. anyway, after 3 months my son and his friends got a letter about being a candidate for community service with specific instructions that if they don't do the community service they will be prosecuted. My son and his friends did their community service and promptly submitted the papers involved. After a month my son (only him and not his friends) all of a sudden got a letter informing him that he is being prosecuted and has a date and time for trial scheduled 2 days after the letter arrived. However, on the day of the trial we showed the prosecutor the copy of my son's excellent community service (24 hours). He said my son can go home and he entered Nolle Prosequi on the case. It was all a mistake due to the papers not arriving on time to where it should have gone in the first place. We don't know if my son has any criminal records. But we think we will include a letter of explanation and the original copy of the letter which states the Nolle Prosequi statement. Any thoughts on this?

06/14/2007 - recvd NOA1 (letter of one year extension)

06/24/2007 - Aussie Girl's condl PRC expires

06/27/2007 - Biometrics appt. Done!

12/14/2007 - Aussie Girl's removal of condition approved!

03/25/2008 - eligible to apply for US Citzenship

08/05/2011 - sent N-400

08/11/2011 - check cashed

08/16/2011 - received NOA (priority date 08/09/2011)

08/22/2011 - USCIS sent Fprint schedule

08/25/2011 - received Biometrics letter

09/08/2011 - Fingerprinting appointment

10/07/2011 - Interview scheduled; Interview letter issued

11/15/2011 - Interview appointment - now a U.S. Citizen!
