I requested my SSN on the occasion of my EAD application back in August 2020 and it is taking forever to get granted. The problem is that I need a SSN before my husband can file his taxes this year in order for us to file it jointly.

Question: Can I request a SSN thru a Social Security Office instead of waiting for the EAD to get approved? Has anybody done that before or am I stuck with waiting for the EAD approval?

SSN needs a proof of your status before issuing so you can't until you have your work permit.

thanks for trying to help NancyNguyen but i think you are mistaken. I could have gotten my SSN within  after 2 weeks of my arrival in the US if it wasn't for this stupid pandemic. Without even having filed for the AOS yet, that's just a fact.

Yes but your K1 is gone. When your K1 is gone, you will need work permit for SSN card.

Yes, as soon as you get your EAD, you can walk-in (if allowed by then) or book appointment for it.

Thanks NancyNguyen! In fact because my K1 visa is expired I have no choice but to wait for the EAD to get my SSN.

 

I was calling USCIS to try to get some info but they kept hanging up on me and not let me talk to a representative.

So after what you told me here I decided to call SSA to get some clarification and they confirmed that I can't get my SSN thru them anymore because my K1 visa expired. However, if my k1 visa was still valid I could have gotten a SSN card thru them even tho I had already requested thru the EAD. They said they'd give 21 days for the USCIS to issue the SSN card and if they don't do that within that time frame, SSA would then issue it for you.

 

So yeah, it turns out that my initial question here: Can I request a SSN card thru SSA when I have already requested thru EAD is: YES, they will issue it for you if USCIS doesn't do that within a time frame.

HOWEVER, as NancyNguyen pointed out, if my K1 visa expired, then the only way is to wait for the EAD to get approved to receive your SSN card either thru the USCIS (if you requested it with your EAD app) or in order to be able to request it before the SSA.

I know it doesn't make sense that a K1 immigrant can with the I 94 form apply for SS # within 90 days but not after that and a marriage

 

but to help you in future with anything done here in any office government or otherwise

the rules (and laws) are made (ridiculous as some of them seem) because someone in the past found a  way to skit the system and therefore make the progress more difficult and at times seem foolish

 

you will find out this applies to rules for loans,  SS office,  IRS,  insurance,  etc (any business you are about to do in the USA)

You don't need an SSN to file your taxes. I haven't done this yet, but it appears that you file a W-7 with your tax return, and that will cause the IRS to assign you an ITIN

1 - I do not have SSN and am currently not eligible to obtain one because I don't have a work permit, so check. 2 - i am not quite sure, but i suppose because i am married my household income becomes one and i will be required to file a federal tax return, so check. 3 - i'm a spouse of a us citizen, so check.

I guess I am eligible for the ITIN after all! I will definitely give this a try, thanks a lot JonSeattle!

Just to clarify, it's 76 days to be able to apply for SSN.

That's what we used to file our first years taxes. If you use Your ITIN to file taxes when you get your real SSN notify IRS that you now have a SSN and give it to them so they can associate both numbers together.

You use form w7 and file for a ITN as a foreign spouse for tax purposes... you can’t get snn without legal work or stay authority
