Just to confirm, there's no record of birth certificate in general and the court letter is confirming this?

He usually can order for copy certified of Birth certificate. My husband request in Boston in 2000 and he got it the copy that is work as the original birth certificate

Depends on the country. Not all countries have certified copies. 
my husband had to get “proof” that wasn’t a “birth certificate”. They accepted it. They also know which countries have alternate forms of documentation. 
NVC will accept “proof” of birth. You may need to call them to see if they accept the documentation that you have.

he has to go to NPC (National Population Commission) in any state to get his attention of birth or any local government to get it done

You better tell him to get his birth certificate at NPC at any local governments in his state Nigeria or he should go to NPC in SURULERE lagos Nigeria,for you guys to afford his visa not to be refused or for him not to be put in 221g Ap
