Hey everyone,

Well, my husband got an RFE for his AOS. They are requesting my I-864 once again (although we already sent it in) and then they said we don't qualify and we need a co-sponsor. I'm kind of confused since I make above the poverty limit, but I guess they consider my job history not too stable (recent college grad, not too long in my current job, etc.) Anyway, my dad is willing to co-sponsor and I just want to give them what they want.

I've been reading for a while on VJ, and it seems my dad (along with myself) can file the I-864A. I will also have to file the I-864 for myself. Now my question is, does that mean my dad and myself are joint sponsors? I am confused will all the wording because form I-864A is a "Contract between household member and sponsor." My father will also become a joint sponsor correct?

I-864A is only used if your father's income is being included on your I-864. To do this your father has to live with you. Its a bit different to having a full "joint sponsor", but it will work for you if he makes enough money to meet the poverty limit. You will have to send in a revised I-864 for yourself and a I-864A for you father in response to the RFE.

If your father doesn't live with you he needs to fill out a separate I-864. That is the normal definition of a "joint sponsor".
