Contact should always be done to the entity that is in "possession" of the petition

YMMV

contact the embassy but understand you need to read all applications and make sure they are correct before signing as you are ultimately responsible for the content

was the application the only place this was not addressed?

as divorce papers should have been included with the application

and mentioned on the ds 160

then much of this will be country dependent and at the decretion of the CO during interview

all he can do is show the papers and answer the questions honestly

understand there are some countries that are known for making false documents and that is why i say country dependent

so,   please do a timeline and inform us of the country involved as it helps to know

Are you saying this wasn't included in the original Petition you filed?  If not, good luck.

It also depends on whether the omitted information is about the petitioner or the visa applicant.  Which entity is the OP?

A careful read of the first post would certainly indicate the OP is the USC ("... me submit the petition for my husband...").  If so,  the omitted information is in regards to the beneficiary.

Yeah.  Missed the "his".  Being Ivory Coast, anything could happen.  It's already been mentioned the "the person who submitted" is not an excuse.  Did the petitioner not know of the beneficiary's past marriage, or just fail to carefully read what was signed?  Too many unanswered questions, but definitely the DS260 asks about prior marriages for the beneficiary.  Can of worms that could have been avoided by putting a higher priority on accuracy and truth.

OP, you're 100% responsible for the content of any form or petition you submit, regardless of who prepares it.  For a high fraud African country, failure to document a previous marriage is a pretty large omission.  You may have an uphill battle, as the burden of proof to demonstrate there is no fraud involved will be on you guys.
