Timeline

My 5 year old child will be going for his interview this month. He has been staying with his grandma after I came to the US. His biological father has never been there in his life even before he was born he didn’t want anything to do with the child. The father is therefore not there on the birth certificate and on DS260 I wrote father was unknown. Should I reschedule the interview? Or How do I go about this at the interview since I can not get him to give consent? Thank you

Well that would depend on the legal system of the country concerned, usually a Court Order would suffice.

Oh boy.  The father is not unknown.  You do know who he is.  He's just not listed on the birth certificate.  You lied on the I-130 and DS-260 because the father is not "unknown" as you listed.

This will probably fly under the radar.

Really depends on what sort of checks they do, that was my thought but you never know.

You will be fine. Father not on Birth Certificate and not in his life. But yes double check if you can get something from the courts saying you have sole custody. If not still have the inteview and if they request consent then try and find him. But if you cancel your interview no telling when you will get another. Good luck. I brought all 3 of my children with no father consent. In the eyes of the embassy my husband was their father since he was there for years.
