Hello All,

My fiancé arrived in the US on Dec 22nd, 2020. It has been a stressful journey waiting on paperwork, getting things process and the interview. I just want to say VJ community has been extremely helpful.

1. My fiancé and I are getting married on Jan 8th, 2021. After that, we are planning to get SSN before we get on AOS paperwork.

However, all the SSN office are closed, they require people to book an appointment to see them in person. When i called in, the agents told me to send in the application (SS-5), her i-94, passport, and birth certificate before they actually schedule an appointment with me. Has anyone encounter this when one applies for SSN for his or her spouses with K1? If i apply for the SSN, how long is the wait for her to get her SSN? The reason i ask because i am planning to add her to my health insurance and other things.

2. After my fiance and i get married, what is the due date to turn in AOS? I read a couple of posts on VJ saying that as soon as people get married, AOS can be turned in anytime? Is this true?

3. How DIFFICULT is the AOS paperwork, as well as the interview? My fiance and i are starting to get nervous again since her previous interview was so stressful. I am thinking of getting some help with the AOS paperwork, one guy quoted me for 300 bucks to fill everything out. I am aware that if she and i fail the interview, she will get sent back to the country, which is the reason why i am hesitated to do it myself.

1. Not sure how long the wait is in these times for the SSC.  In ordinary times,it was something like 10-14 days.

2.  There is no due date for the AOS, but after the 90 days from the K1 entry expires, technically one would be out of status and potentially deportable.  Once the AOS is filed and the NOA received, then one has sort of a legal status at least until the GC is issued or the AOS is denied.  Most folks here on VJ will recommend filing the AOS as soon as you can.

3.  The AOS paperwork is fairly easy and can be done by oneself generally assuming there are no big issues such as criminal convictions.  There are always folks here on VJ that will be happy to help with specific questions.  I should note that even when using a service or a lawyer, the applicant still has to do all the legwork, and they should also scrutinize the final product.

Good Luck!

Either before or after marriage. Seems most straightforward when applied in name on K-1 visa (i.e. maiden name) and then changes it later if she fills out AOS froms with married version of name. Earlier is better to allow for processing; the initial deadline is 76 days from entry: https://secure.ssa.gov/poms.nsf/lnx/0110213300

If, within the next 14 calendar days from the current date, either the person’s lawful alien evidence expires or the person’s lawful alien status expires, do not process the SSN application. In these situations, SSA cannot print and mail the SSN card to the applicant before the lawful alien document or alien status expires. Instead, provide written notice (SSA-L676, Refusal to Process SSN Application) to the applicant explaining why you cannot process the SSN application and delete the application.

Have you tried calling a different local SSA office? https://www.ssa.gov/coronavirus/

I need help with my Social Security Number (SSN)

We are prioritizing requests for in-person SSN services for:

  • Individuals age 12 or older applying for their first SSN card.
  • Individuals who need to update or correct their SSN information (such as your name, date of birth, or citizenship) to obtain income, resources, or medical care or coverage, or other services or benefits (for example filing a tax return, applying for housing, or seeking an Economic Impact Payment).

If you believe you qualify for an in-person appointment, call your local office. You can look up the phone number for your local office by accessing our office locator. Please note that appointments may not be immediately available, depending on local health and safety conditions and staffing.

There is no "due date" since the requirement is to just get married within the 90 days. But after I-94 date passes she'll be out of status. Being out of status is risky:

Thank you.

When i file the AOS paperwork, if the SSN did not come in time, Will i still be able to fill out the form? I briefly looked at the form, and it says to list out SSN.

You can request a SSN on the AOS application. My wife did not need one for health insurance or to get her learner's permit, but Washington State appears to be much more lenient for immigrants than other states.
