Trespassers?

  1. 1. You leave your house door open. People waltz into your home and you give them chores to do. You make them live in the basement, you don't pay them a legal minimum wage. After 10 years of such service, if you were to accuse these workers of trespassing on your property, would you be right?

    • Yes - I didn't invite them in. So what if I left the door open and let them do my chores?

    • No - I left the door open. I used their services for all these years. It would be hypocritical to call them trespassers now.

The only people who would do that IMO are those bloody Jehova's Witness types. Had a couple of those turn up on my doorstep quite unannounced - and politely offered to 'help around the house'. For a moment I was tempted - but I couldn't put up with the preaching. Of course - earphones would probably have done the trick!

It would make more sense if the house is an apartment. The landlord did nothing; the legal resident had no power, as the authorities would not act without the landlord's consent.

Fuzzness is correct though. If you let someone live in your house for a long time (even if you own it), legally they're considered your tenants and have just as much right to be there as any tenant in an apartment building and need to be evicted the same way, through a long and often expensive and drawn-out court process.

I think you WOULD have to right to randomly kick them out of your house after they've been there for 10 years. Just because you left the door open, that doesn't give people the right to come in. Also, if you asked these people to leave your house as soon as they walked in, WOULD THEY HAVE LEFT? I somehow think it would have been hard to get them to go...

But I don't think the US should start mass deportations and I think most people agree that that is not the answer. But neither is blanket amnesty, imo. People also shouldn't be instantly rewarded for breaking the law while others struggle to accomplish things the legal way.

Nothing long and drawn out about eviction in states where there are no tenents rights laws. That would be ruling in this case. Out they go! :thumbs:

They don't have the right to come in just because you opened the door, and if you'd called the police as soon as you saw them, the police could have removed them.

However, if you let them stay for 10 years, then legally speaking they are your tenants (yes, even if they don't pay rent) and you can't just call the police and have them removed.

In other words, it's not the fact that you left the door open that means you can't just call the police to throw them out. It's the fact that you then let them live in your house for ten years.
