I'd like to visit for about 3 weeks but I don't want to file it entirely as leave. I have visited thrice before but never got asked about my leave letter from work. But IF, for this visit, I get asked by the CBP officer about my leave and he/she looks at my return date, he/she would note that there is a gap on the dates. Would there be an issue if I say I'm WFH on that gap?

It could be. Hopefully you are not asked about the gap, but in case you are, the only real option is to answer truthfully. 

 

I completely understand wanting to spend as much time with your spouse. But working remotely from the States is a gray area and I personally would not take the risk. 

 

Would it help to reframe it this way? How much quality time are you going to get with your spouse if you're working remotely, especially if you decide to remain available during PH working hours? That implies you'd stay up all night during US hours. Would it be possible for you to simply take all the days off, and have a real vacation without thinking about work?

My husband will actually be WFH at daytime. I can also request to work on the same schedule. He can't take off work that long since he's just starting next month. I think at most we can only have a week of real vacation, not because of my schedule but his. 

 

But if WFH while visiting would be a problem, I'd rather just file it as leave entirely.

You're welcome :) My personal opinion is, a short, work-free vacation where you can maximize quality time together  is much better than an extended vacation where one or both of you have work at the back of your minds. Happy new year and hope you get that quality time soon!
