K3 in hand, entered in USA, now what?

:help: My wife has now been granted her K3 visa and is here in the USA with me, thank GOD! I am not sure what to file now that she is here. In our form 230 it asks if we would like the sharing of our info for a Social Security number, does this mean they are going to send that to us in the mail now? I am thinking i need to file form I485 for adjustment of status, but the form asks for social numbers and I9 numbers, which of course we do not have. So do we need to go to our local Social office to get a number? I am confused again, thanks in advance for your help once again.

That check box for SSN only applies to CR-1/IR-1 visa, SSA won't send you one, in fact the won't issue an SSN to a K-3 until the K-3 either has EAD card or has adjusted status and has the green-card.

You have all numbers on the AOS form that are needed except the SSN, just put NONE there/

One note, if you plan on getting the EAD file for it before AOS, that way the EAD expire date is tied to that of the I-94 card in the passport, up to 2 years, if you apply for EAD with or after applying for AOS the EAD card will only be good for 1 year, this may not matter if green-card shows up in less than a year.

Get moving and file the I-485 as fees will go from $395 to $1015 for the AOS July 30, 2007.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

Ok, thank you for the input. I have everything filled out for the AOS now, but still hung up on the I-94. I do not know what the I-94 is. Is it the pink sticker with numbers on the very back of the passport put there by the embassy? Or is it some paper that the customs still has at the airport? Please tell me what the I-94 is and looks like with what info on it. Thanks a million again. We appreciate all the input very much. :thumbs:

Arrival-Departure Record (I-94)

What is an Arrival-Departure Document and Why Do I Need One?

A USCIS Form I-94 (Arrival-Departure Record) or Form I-95 (Crewman's Landing Permit) shows the date you arrived in the United States and the "Admitted Until" date, the date when your authorized period of stay expires. You will receive an USCIS Form I-94 or I-95 from an USCIS inspector when arriving in the United States at a land border port-of-entry or from an airline or ship representative when arriving at an air or sea port-of-entry by aircraft or ship. The form must be completed and presented to an USCIS inspector who may ask you questions about the purpose of your trip, how long you will be in the United States, and your residence abroad. Do not lose this form. When you leave the country, you should give the USCIS Form I-94 or I-95 to your airline or ship representative, or, if you are departing over a land border, give it to a Mexican or Canadian immigration inspector. An USCIS Form I-94 or I-95 that has been approved by an USCIS inspector can prove that you arrived in the country legally and that you have not stayed beyond the period of stay authorized. In addition, turning in USCIS Form I-94 or I-95 to the proper authorities when you leave the country can prove that you did not violate U.S. laws by staying in the country too long. Proof that you are willing to obey U.S. immigration laws will be very important if you again want to travel to the U.S. as an immigrant or nonimmigrant in the future.

If you are applying for an extension of stay or change of status, you will also need to be issued an USCIS Form I-94 or I-95 if you were not issued one of these documents when you entered the country.

Canadians who travel to the United States as tourists or on business generally do not need an USCIS Form I-94. Also, certain Mexicans who have a nonresident alien Mexican border crossing card (commonly known as a laser visa), or a multiple-entry nonimmigrant visa may not need an USCIS Form I-94.

If your USCIS Form I-94 (Arrival - Departure Record) or USCIS Form I-95 (Crewman's Landing Permit) is lost, stolen, or mutilated, you must replace it.

Was your wife given anything or had anything put in her passport when she entered and had her picture and fingerprints taken? Thats when she should have received the I-94. I'm not sure what it looks like since I've never seen one myself, but it would have been put in her passport at the airport not at the embassy.

She should have filled out the I-94 either at the airport or on the plane with her customs declaration. They should have stapled it into her passport when she cleared customs.

Or what else could we use instead? Also, will we absolutely need an I-94 for anything if we do not plan on leaving the U.S. until she is permanent resident? How did your wife enter the country? Usually, they hand out these forms on the plane (white for visa holders and green for visa waivers). It is hard for me to understand how this process was skipped by US immigration in these times.

To replace your I-94 card, you will have to file form I-102 and send it to USCIS along with the appropriate filing fee. You can also use this form to get a new I-94 assuming you never got one. I would attach a detailed cover letter explaining what happened with her and include all other evidence you have that she entered the country leagally (you mentioned a passport stamp above).
