That's the I-751 status but we also filed N-400. With our N-400 filed I wonder if it is better to hope for a combo-processing of them together, even if it means that I-751 is delayed more.

Hello folks:

 

So I finally got an update on my application; as of Nov 17, 2021, case is ready to be scheduled for an interview. I am still waiting on the schedule confirmation. I was wondering if anyone would be able to help answer the following questions:

 

1) When do you 'think' the scheduled date would be? I am travelling overseas today for 2 weeks - I will be using my expired green card + unexpired extension to enter back in USA; I am assuming it is fine to do so - I had no problem returning from Mexico but a bit anxious about going to Pakistan and returning ... 

 

2) Do you recommend filing for Citizenship while my interview is being scheduled, or just wait it out until GC is approved? How long after the interview is the GC usually granted?

 

3) Any tips on preparing for the interview? My wife will accompany me ...

That's the I-751 status but we also filed N-400. With our N-400 filed I wonder if it is better to hope for a combo-processing of them together, even if it means that I-751 is delayed more. 

Decision on N-400 is made only after I-751 is approved. Filing N-400 should accelerate your I-751 processing time. I'm hoping Newark N400 processing time (13 to 19.5 months) improves.

1. Interview is likely to be after a month or two. Wait for the official USCIS notice. Traveling overseas with expired green card + extension is fine. 

 

2. I think its better to wait until your ROC is approved. Approval time for I-751 depends on the officer + how well your interview went. In most cases, I-751 is approved within 1 to 2 weeks.

 

3. No need to stress for the interview. Questions will based on your relationship, kids (if any), job, shared assets, and finances.

Hey everybody

 

I hope some of you can help. As you may remember we all were waiting very long at the beginning of this year to hear if USCIS actually received our cases. Most of you had a way to track you package. Because of my own stupidity I forgot to put a tracker on it. 

Quite a few of us got the NOA1 after the expiration date of our greencard.

I got a letter from USCIS today for an RFE, "why I filed late". I didn't. I filed within time but I have no way to prove it with a receipt from USPS for example. 

Did anybody have the same problem or some advise of what to do? 

The only thing I can think of is adding a Screenshot from visa journey when I posted that I sent it and forgot the tracker. But I can't think of any other evidence. 

I'd appreciate all the help you can give me!

How did you pay the fee? If you paid by personal check you can see when it was cashed by USCIS, same with credit card, and get the statement when the card was charged ( you will also have the date on the check when it was written). If you paid by money order, hopefully you can get info on when it was purchased and cashed, and you have a receipt of some sort of when you bought the money order.

 

Did you pay for shipping by credit card, if so get a copy of that receipt  or item in the statement.

 

Did you mail off your application near the due date (expiration date on CGC) and the delivery got delayed, when did USCIS indicate when your i751 arrived at the Lockbox? How long did it take to arrive from being shipped?? It could be your delivery was held up due to poor weather conditions or COVID issues and arrived late to USCIS, if so just provide that explanation to USCIS as to why it was late.It was mail on XXXX date and was delayed in shipping x number of days.

 

USCIS just needs an explanation as to why it was late, so just explain I shipped my i751 on xxx date and my shipment took longer than expected  or USCIS processed my application on YYYY date which was X number of days before my CGC expired.

I'll see what I can do about the payment to prove I took it out way before my window closed.

 

My window started end of November 2020. I sent my package on 12/28/2020. My Greencard expired on 01/29/2021 and USCIS now states I filed late because my NOA1 says 02/05/2021.

 

I guess I'll add some screenshots from here, when we took out the cashiers check and a long letter about when we sent it, holidays, covid, and stuff.

Wow only a week late, you should be able to overcome with a basic explanation that your application was held up in shipping, which I suspect it was. 

 

Other late filers are aften weeks or months late in  filing due to filing an i90 in place of an i751 or just forgetting to file altogether. UDCIS routinely accepts late applications with reasonable explanations.

 

If you can provide proof that you paid for your shipping of your i751 application on 12/28 that would be good proof along with getting the date you purchased the money order.

Thank you, that gives me a little hope. 

I can't prove the shipping as I just put stamps on the envelope and then threw it in the mailbox. But I do have a bank statement when the cashiers check was taken out, to be put in the package. And of course all the screenshots of when I mentioned the day I sent my package. I know its not real proof but it maybe helps a little as I kept repeating the same date online over several posts.

My service center is WAC. I was expecting to receive information in 2023 ... however received a gift of relief this past Monday.  here is my timeline:

 

01/09/21 - Case Created

01/11/21 - application to remove conditions sent via UPS

02/12/21 - Text received confirming the case received

02/12/21 - check cashed

02/11/21 - NOA produced

02/22/21 - NOA received (with 18 month extension from original expiry date)

10/04/21 - NOA received (with 24 month extension from original expiry date)

10/24/21 - Case Inquiry published (based on USCIS processing window being displayed as 6-9 months)

11/03/21 - Inquiry response received with indication that case is currently being adjudicated

11/29/21 - Case Approved NOA received. Card being produced within 60 days.

[i tried to login to my uscis account and messed up/locked it so don't know the current status about the card.]

 

(the edit:) Please note, i did not receive any RFEs or Interview requests or biometrics requests. They were skipped.

 

People asked me how i felt and if i was happy. I said i was relieved, not happy.

Thank you for posting your info. We are WAC filer as well. Did your case go from “case received” to “case approved”?  It seems so since you received no biometric notice/waiver.
