K-1 Visa Petition Expired Due to Covid. Now what?

Does this mean we are to start all over again??? It's not our fault that COVID hit and they cancelled every scheduled interview.

 

 

I just thought I would check our status again and got this...

Since you have failed to do so, the record of your registration and any petition approved on your behalf and all supporting documents have been destroyed; any Department of Labor certification has been returned to your prospective employer.

So then what about this!?? It was saying December 31, 2021 and now its September 2022.

 

 

Extension of Visa Fee Validity

The U.S. Department of State understands that many visa applicants have paid the visa application processing fee and are still waiting to schedule a visa appointment. We are working diligently to restore all routine visa operations as quickly and safely as possible. In the meantime, rest assured that U.S. Missions will extend the validity of your payment (known as the MRV fee) until September 30, 2022, to allow all applicants who were unable to schedule a visa appointment as a result of the suspension of routine consular operations an opportunity to schedule and/or attend a visa appointment with the already paid fee. Please continue to monitor this site for information on when we will return to routine visa operations.

You are not the first.  Almost all 2020 petitions approvals are in this situation.   The consulate will extend the validity of the petition.

I know we're not the first. What are we supposed to do now though? AIS still says to schedule an interview, but none are still available as they're not even doing K-1's.

I have spent countless hours on VJ doing research over the past two years. I don't have time to scroll through countless forums for a SIMPLE answer, as MOST topics NEVER give a DEFINITE answer.  Thank you though.

OP, the UK regional forum is not "countless" and contains many answers.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Did this happen? Were you informed earlier and did not contact the embassy?

Then I would start by using the London contact form https://uk.usembassy.gov/visas/iv-contact_form/

 

Say something like—

Due to suspension of K1 interviews in London, I have been unable to schedule an interview. Now I have been informed by the US Department of State that... (copy what they said). Contrary to what the State Department says, I was not contacted about this previously and have regularly followed everything on the the London embassy’s Covid-19 page. I wish to assure you that my fiancé and I remain free to marry and intend to marry within 90 days of my entry into the US on a K1 Visa. Please advise if you need that in writing from my fiancé. And please advise if you have thrown out my case or if I should continue to follow London updates which say to wait until the embassy resumes processing.

 

Then hold your breath that they respond to you within a short time with some answers. 
 

An issue they might have is that why didn’t you get on with it in December 2019, months before any lockdowns or visa suspensions occurred. You might want to address that in the contact form you submit. What date did you submit the DS-160 which is your visa application?

The would appear the above notice is for an i129 not i129f
