Hey All, 

 

I'm trying to get my Citizenship application done on basis of being married to a US Citizen for 3 years and submitted in a timly manner, but I'm stuck on those questions.

 

Have you EVER been arrested, cited, or detained by any law enforcement officer (including any immigration official or any official of the U.S. armed forces) for any reason?

 

I got tickets for talking on the phone while driving, running a stop signs (actually I stopped for 1 sec and the cops pulled me over which I understood why) and back in 2009 when I was out of status I got a ticket for driving without a license, I had to go to court in all examples (except running a stop sign). Do I have to mention all that in that question and provide evidence of paying a fine?

 

Another question is about my wife's previews marriage. They question asks about date of birth of my wifes previews spouse but she doesnt remember exact date. Do I have to give them a date or can I leave it blank.

usually traffic citations are not a matter for naturalization, but if they involve a misdemeanor or a felony then you have to declare that with court documentation and more.

Well I have never comitted a crime of any level. Tickets for driving like an idiot and one accident that nothing happened to anyone, also one time driving without a license and I had to go to court (handheld device is a mandatory court appearance in NJ).

well, its not what u consider a crime....citations could be jaywalking...doesnt mean you can just dismiss it. I was "cited" for something and had to declare that. Not going to get into details about it.

Use the N400 instructions when you prepare your application.

The answer for the first question is "Yes", you have to list all traffic tickets. If any of them is more than $500, then you have to provide evidence of payment.

Read instructions for the second question, and if you do not find the answer, then I suggest you write the date your wife remembers and add a note that she is not sure of the date. That is better than leaving the question unanswered.

Yes, you have to disclose all citations, and provide relevant court records.

Doesn't your wife have her marriage certificate? That should have the spouses' dates of birth.

The marriage was in 2001 and ended with a divorce in 2006, but to my knowledge she doesn't have any marriage certificate from that marriage. I hope she can find the divorce paperwork with his birthday date on it.

Non of them where anywhere near $500. Most of the tickets I got where around $100-200 with the exception of the ticket I got for driving and using my cellphone which was around $300. I did disclose all the major tickets that I got and I was able to find using court records.

i know its a pain and it may delay your application, but it's best to disclose everything. They look for your moral character. Hence to disclose all. Traffic tickets are not necessary though. In my case i had to go back almost 12 years on a citation and had to get a printout of the court records. It was expunged, but they needed to see what had happened.

 

About the divorce from your wife, if she can get divorce papers or actual copy of the marriage license could help.
