Hi guys!

 

I am filing the form I-944 and I find it very complicated compared to I-130 and I-485.

 

The questions are asking about the income earned during the previous years, backed-up by tax returns.

 

My wife never filed a tax return as she was under the threshold (I indicated that).

 

She now makes well above the 125% of the Poverty Guidelines.

 

I don't see anywhere on the I-944 form where I could write down her current income and explain the situation.

 

Should we write a letter explaining it on the separate page, or even use the Part.9 additional information if we have enough space on there?

As I said in another post, my wife made less than the $12,000/year threshold for the last couple of years as she was a student so she never filed her tax returns.

 

She JUST started a job in October that pays pretty well.

 

We are limited by time, I have to send my AOS package next week so even if she filed the 2020 tax return we won't get it back before a couple of weeks.

 

In another post everybody told me that current income is KING and that we don't even need a joint sponsor.

 

So we're trying to reflect her current income on the form I-944.

 

I think I figured it out tho we're explaining it in Additional Info and we will even provide further explanation on a separate sheet of paper.

Her current income is gonna go on the 864, questions 7-20. This is the form used to determine her eligibility as a qualified sponsor.

 

The I-944 asks for the Total Income on the returns, if any. Since she didn't file any returns, that's what you're gonna write down.

 

Focus on proving the current income on the 864 form. She needs to get an employment verification letter and paystubs to prove her current annual income.
