Hi all,

 

I wanna know your thoughts on my dad’s case petitioning for his wife. We are preparing the AOS form now. He will be making roughly $25,000++ based on his last pay check for 2020. He is a lawful permanent resident who immigrated here Oct 2019. He started working Jan 2020. We’re thinking of filing his taxes early in Jan 2021 so we can use it for the AOS but his income will just be a little bit over the required income of $21.5k for a household size of 2 (just him and his wife).

 

Do you think his 2020 tax will be enough? or should I just co sponsor since he does not have the 3 year work history here to back him up?

Also, just so we get this right, for 5.a. we should check NO since he didn’t file for all the THREE most recent tax years. Is it required to provide an explanation as to why he didn’t file for the other 2 years? 

 

And, on 6.a. we should only provide the total income for the most recent year (2020) and place N/A on the 2nd and 3rd most recent, does this sound right?

I think you should be prepared to co-sponsor, just in case. Will his wife be working once she is legally allowed to?

 

I’m sorry, I used AOS to mean affidavit of support. Yikes! Didn’t meant to cause confusion.
