Hello All,

 

New Member here, short story my Fiance is in Argentina and I sent the I-129f recently, It was received November 11 2020, I just have the receipt hard copy and no more updates, yesterday I did talk to an agent from USCIS over the phone and she told me most likely 6 months so be patient until March 2021. My only concern is the two years meeting requirement, I know my fiance since 2012 but we haven't seen each other in the past 2 years so I tried to visit her in Argentina but the country still has a Travel ban it is closed for tourist, I did include an explanation letter about it with my I-129f package, let's see I'll keep you posted. The good thing we booked for Mexico this month and had our meeting with tons of proof if needed.

Sounds like you wasted the filing fee for the first petition if you had not met within 2 years of filing the I-129f.  Sorry.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

So when you filed, you did not meet the requirement of having met at least once in the two years prior to filing? And then this month you were able to meet in person? Why did you not wait to file until after this month's meeting?

Hello because we know each other since 2010 I used to work by her place and we have been friends we haven’t seen in the previous 2 years but I know her long time ago

The length of time you have known her is irrelevant.  You must have actually been face-to-face within 2 years of having submitted the I-129f.  The law is very clear.  We have seen this before.  You will be asked to show evidence of having met within 2 years.  If you cannot provide that evidence, your case will be denied.  If you have since actually met, you can submit another I-129f....with another fee.

It does not matter how long you have known each other. At the time of filing, you did not meet the requirements. If you had waited to file until after you were able to meet in person again, you would not have wasted the filing fee.

You've completely missed the primary requirement, which is to have met in person in the immediate two years prior to filing.  Doesn't matter if you first met 30 years ago, that requirement is strict.

Chalk it up to a $525 mistake and refile once you've seen each other again.  And maybe start reading and researching all things immigration thoroughly first.  US immigration is complicated, and you need to become educated in the process.

Too late.  The package was received on November 11th.  That fee was gone before USCIS issued his receipt notice.  OP will likely get an RFE for evidence proving a meeting within the 2 years prior to filing.  After he fails to provide that evidence, the petition will be denied.  The fee is payment for processing the petition.....it is not payment for approval.

Hello well I appreciate all the comments, let’s see what happens, I have no power to predict the future like you guys and also I know how to read! Money is not a problem thank God I have an amazing career I forgot to mention I did requested a waiver for extreme hardship the Argentina Government still up to date has a travel ban for tourist so technically I can’t go there, the us embassy told me I can’t travel there I did include my two canceled air tickets and more evidence, in November 2020 Argentina authorized their residents to travel and that’s why we booked Mexico to have our meeting, let’s see I have nothing to do but wait, I hope the best for all of you in 2021

I am sorry to report that we have seen this situation multiple times in the past.  No one, to my knowledge, has been successful in bypassing the 2 year requirement.

Not true. Use this time to research the process and requirements. You will then learn that this petition will not be approved because you failed to meet one of the basic requirements. Then you can work on refiling.

It is not about predicting the future. It is very simple. You did not meet the requirements.
