You can get married now and then your spouse can file an I 130.

 

Well with the Pandemic complicating travel arrangements he can file as soon as you marry and obtain the marriage certificate. You current case is on the basis of being married and it seems you are not.

Suggestions regarding this:

 

Is permission from the first wife required in Moroccan law?  Check to make sure.  Sometimes the country laws are not exactly the same as Islamic law.  If a court in Morocco and issue a judgment saying that the second marriage is void/annulled, that would clear things up.  Your current marriage would technically be void, and then you could remarry.  It may take a while, but unfortunately that is the process you will have to go through.

The marriage not in Morocco  it was in emarat the law there is different

But you registered it in Morocco, ok this is well outside my area but would it not need to meet their law?

This is NOT DO-IT-YOURSELF.   You need professional competent legal help.

Getting marry again does NOT ERASE the fact that you husband was married to two women at the same time.  Getting marry again does not make him qualify to petition for you.  You can not legally marry someone who you are already married to and claim a new start date for your marriage.   The US Embassy already has your old DS-260.  They already know when your marriage started.  They already have your marriage certificate.  So there is NO WAY they are going to accept your new marriage certificate.  In fact, you may be accused of fraud which may mean NEVER immigrating to the US.

 

You can either fix this the right way with help from a competent US immigration lawyer or screw this up forever by doing it yourself.  You have been warned.  

Well i asked  2 immigration lawyers in usa they told me to marry again

Does not matter that the marriage is not registered in Morocco.

 

You already gave the US Embassy a copy of your marriage certificate from the UAE and your husband's divorce certificate.  They already know everything.


When you file the new I-130 and DS-260, you will need to disclose ALL your marriages.  Including the one from the UAE.  If you do not disclose this information, you will by committing fraud.

That's incorrect advice.

 

OP has already had an I-130, DS-260, and an IR-1 interview.  The US Embassy has her UAE marriage certificate and her husband's divorce certificate.  They know that he was not divorced when they got marry.  That was why her immigration visa was denied.  

 

With the new marriage certificate, how does OP overcome the fact that she needs to disclose prior marriages and provide documents?  If she fail to disclose facts and documents that the US Embassy already has, she would be committing fraud by omission that is EASY for them to prove.
